SAS drives 6Gb drives running at only 3Gb

Quick question and I sort of know what the answers might be but just in case I've missed something. Somebody I know sold a pair of 146GB SAS 15K 6G drives on ebay. When putting up the ad he managed to get the model number of the drives wrong, so for example the model should be ABC1234552 but he advertised them as ABC1234553 and that mistake propagated throughout the entire auction. The picture of the drives showed the correct model number though.

The buyer has come back stating that he's not received the correct drives as per the auction and to make things worse the mistaken model number drive type actually exists. The buyers main gripe is that the drives won't run at 6G but the spec sheet for the drives confirms that they are 6G capable drives. I've actually tried the remaining drives in my server and my SAS RAID card correctly identifies them as 6G capable and shows that they are running at a link speed of 600MB/sec.

The obvious thing to do is to ask the buyer to return the drives but he's responded to the buyer to state that yes he did make a mistake with the model number but that the drives are 6G capable and that's the last he's heard but I was wondering apart from the card that the drives are connected to what else could cause the drives to run at 3G. Would mixing 3G and 6G drives on the same controller or even the same RAID pack cause the entire pack to run at the lower speed? My thinking behind this is if you mix speeds of memory then all the memory normally gets run at the lowest speed.

I suppose a lot does depend on the controller and I don't have any 3G drives so that I can mix drives and see how my controller copes with them.

We've asked the buyer for more info as to be honest I'm sort of intrigued as well to find out the cause.

I've asked, gave screenshots of the drives and their link speed within the DOS LSI BIOS and from within Windows to my friend. He replied to the buyer but since then there's been no contact from the buyer. I've told my friend to prepare for the worst just in case he lodges an item not as described claim.
 
Still no reply from the buyer so either he's sorted it out or he's sitting there seething with the reply that was sent to him?
