Scratched Disc - who's fault?

Right my GOW disc is now so scratched that it's getting non stop disc read errors. The scratches are nearly all the way around the outside and look very much in line with the hole that's in the DVD tray. When playing the game you can hear it come to a abrupt stop but the disc still keeps spinning making a horrible rattling/grinding noise, i guess this is when it happens. The question is, is the drive stopping to quickly by itself, or is the game asking it to stop this quickly because it needs no more information reading? I need to get it replaced but who is liable, MS or the game's publishers?
By the way, non of my other discs are scratched like this but i do play GOW most of the time.
 
My smackdown disc is getting scratched up pretty badly as well. Its obviously the 360 thats causing this so i don't see why we should have to pay to have them replaced. On the other hand my wii and ps3 with their slot loading (quiet) drives the discs are perfectly fine, look as good as new. probably something to do with the fact when the 360 drive spins up it sounds like the disc is being thrown all over the place. :( :mad:
 
It's horizontal. The scratches are defianately in line with that small hole in the drive tray.
 
My saints row is all scratched up and i was actually getting into that game just before it happened :mad: Mines horizontal too
 
Console orientation should not matter. The thing was designed to stand up or sit down. If ms tried to use that as an excuse they'd get laughed at and promptly slapped with a lawsuit.
 
You could try applying to the makers of the game to send you a replacement disc, but it's a long shot.

They may just tell you to bog off :o
 
Just been told by MS that the xbox 360 does not and cannot scratch games and they will not take any responsibility whatsoever...
Really had enough of my 360 experience now, disk read errors, crashing, freezing, noise, two dead consoles, PS3 here i come.

Holy crap :eek: just seen all the various forum threads about this and GOW discs, niether epic or MS take any responsibility at all. Mark Rein even comments that maybe our houses have bad power... :confused:

Mm clearly thats gonna make the console scratch discs, feed me with bad power will ya scrape scrape. :confused:

He should stick to bsing to people that gears wasn't gonna come out on pc and stfu.
 
Its pretty common unfortunately, And it's nothing to do with orientation, it's just a bad game/dvd drive combo. Unfortunately, Like you say no one is taking responsibility.

MS, Say its not their fault, And Developers are saying it's not theirs.

Thing is..Someone is to blame, And it's not the user.
 
Not sure what's going on but if it was the plant then you'd have thought other games would be affected. It seems to be GOW that's gets the disk read errors and then they start to scratch.

I've never experianced this (on my 360) but from what I can gather from your post It sounds like the drive's spindle is becoming uneven, that would cause the read disk errors and eventually cause the disk to gain a circular scratch due to the disk leaning to one side, I've had this problem in the past on older anti-shock CD walkmans, first I would notice my anti-shock reducing from 40 sec's to 10/15 secs, this was due to read errors trying to read the disk and not being able to suffeicently top up the anti-shock buffer, then I would start to see circular scratch marks appearing on my cd's usually in the form of a line near the outer rim of the disk going all the way around, all of the CD Walkmans that were sent off for repair it was allways the spindle that was the problem,

I'm guessing what is causing this problem is a combination of bad build quility on drives and also poorly manufactured disks that don't weigh/sit evenly on the drives spindle and due to the speed at which the disk is spinning causes it go out of alignment, causing read errors and eventually scratches on the disk, this is only a theory mind.

If that was the case then either the disc, drive, or both would be to blame, MS are telling me it's my fault and to buy a new one. At certain times when playing GOW the drive stops very quickly and i'm sure I can hear that the disc carries on spinning in the tray, makes a horrible noise when doing so and have half been expecting the things to explode. Going to investigate later and try and get some footage of it doing this, stops me from getting bored atleast :)
