Second class action lawsuit filed against Microsoft

a Microsoft spokesman responding to the Florida suit told InformationWeek that the company has not received a significant number of complaints about scratched discs.
Well I complained about my 360 scratching discs so that's at least one.
 
Yeah the same spokesman that said the failures where within industry standards. Perhaps the spokesman should check out each and every thread on xbox.com and see every single game section has someone crying about disc scratches.

It could end up costing them another Billion ;)

Definately Bye bye Xbox if they have to admit to that as well.

I bet sony can't believe their luck.
 
they can easy fix this though

either by adding a tiny piece to the drives or by forcing people to to use different spec discs with a scratch protection coating i assume

moneys nothing to MS tbh , they could even afford to start again with a whole new console if they wanted

Didnt think this was worthy of starting another thread, but while we are on the subject of lawsuits, it seems Silicon knights (Too Human guys) are sueing Epic over the Unreal 3 engine.

According to a statement from Epic's Mark Rein sent to leading news outlets including Gamasutra, the Unreal Engine 3 creator is the subject of a lawsuit from licensee Silicon Knights, presumably regarding UE3-utilizing Xbox 360 title Too Human.

Rein's statement, sent out to the media this afternoon, reads as follows: "This morning we were served with a lawsuit by Silicon Knights. We believe the claims against us are unfounded and without merit and we intend to fully defend against them."

The Epic VP continues: "We'd love to tell you more about it but unfortunately our lawyers want us to save our comments for the courthouse so we're going to do our best to comply with their wishes."

He concludes: "In that vein we'd appreciate if our friends in the industry and media would refrain from asking us about the suit because we're only going to say "no comment". We just wanted to share the news directly before the rumor mill starts churning."

Representatives from Silicon Knights were not immediately available for comment, but Gamasutra will update this story when more information about the contents of the lawsuit are made available.

I hope they work things out, I was really interested in Too Human, especially the 4 player co-op.
 
Was going to post this myself, not sure the inns and outs of it as yet guess time will tell, but like you said it looked promising. Some are thinking its down to Epic lack of support to SK regarding the UE3, ie if Epic had said we will provide you with this and they dont SK may get a bit snotty that some of the service they've paid for there not getting.

Silicon Knights: Epic Sabotaged Us

Silicon Knights was kind enough to send along both their formal press release concerning their suit against Epic and the actual suit itself.

According to the suit, which seems more than $75,000, Epic Games misrepresented the abilities of their Unreal Engine 3 when selling the license agreement to Silicon Knights. The suit says that Epic failed to "provide a working game engine" to Silicon causing them to "experience considerable losses."

Silicon Knights eventually decided to drop the Unreal engine and instead build their own, according to the suit.

Silicon also claims that Epic has been "sabotaging" Silicon Knights efforts to make a game by using the money earned from their licensing deals to make their own games rather than to provide support for their engine to Silicon and other licensees.

Epic didn't provide a working engine... that sounds odd.
They are gonna have to go some way to make their engine better than the UE3 engine supplied by Epic, hope all goes well.

Not the 360 dissapearing, but there wont be a follow up. They screwed up. Its costing them more than its worth in profit. This gen was supposed to be about moving on from the xbox position. When it all shakes out they will be 3rd.

Great console, I love mine and the games but they wont carry it for another. The 360 has been the biggest PR disaster for an elctrical item I can remember.

I agree the Disc Scratching/3RROD is terrible..

But they at least know that if they design something properly and market it correctly, it can be a pretty good success.. so I am not sure that the poor design elements of the 360 would make them lose sight of the profit making potential consoles can have, they just need to design it correctly next time..
 
Has it damaged the brand too much though?

Also are the problems caused because the console is cheap and they had to cut corners?
The have now implemented the fixes, but this is past the point when you would expect a price cut from the machine, but instead it seems they are fixing the desing flaws.
If they done another console, will they be able to make it reliable and cheap? or will it be one or other again.

Oh its damaged, I would never early adopt to their next system if there was one.

Right up until the flaws I thought the console was the best bit of kit i'd ever bought.

Sony handed them this Gen on a plate and they blew it. The premium if it was within industry standards could have been sold for the cost of a wii. Instead they are keeping the price high. They shouldve been cutting the cost when the PS3 was launched. They havent been able to. I've invested too much this gen to change format, next time I will be more cautious :D

Remember the PS2 lottery with failing Lasers or whatever it was??

I agree that being an early adopter is risky, and I agree with your sentiment, MS will have lost quite a chunk of sales over this, but they are still selling plenty of units, and we all know they still will...
When the 'falcon' re-designed 360's hit stores, this should all be a thing of the past, in 2-3 years no one will probably remember/care..

I'm on my third and final PS2, and it didn't stop me buying a PS3 and with it's noisy fans ("They are supposed to do that sir" from Sony CS) I am not overly confident it'll last the course, but I'd rather risk it then be without..

I took mine back to the shop and just said it was faulty, they didn't even test it!
