Say I bought a copy of the battlechest off ebay, and the code that comes with it is listed as being in use. Do I contact the seller to cancel his account, or Blizzard to get the key validated, or am I screwed?

What was the item description? did he list it as an unused copy? if so you shouldnt have any trouble getting your cash back.

Item description lists contents (original & BC games/guides) and notes that it's in excellent condition, that is all. It's listed as used, but no mention of this invalidating it for a new account or anything of the sort. If it comes down to it, I'll argue that it was his responsibility to include that information or somewhat else indicating that the pack is for replacement purposes only and doesn't entitle you to the license.

Well obviously he was just seling the CE items then.
If it was including key he will be selling AS AN ACCOUNT considering that is says it has been used.

You cannot buy used WoW that has unused key simply because if they've used it, they registered the key ( Unless they only opened it to browse manual ???? which would make no sense ) and if they would like to sell it along with the key - they will not be advertising as CE box BUT as account as whole for sale.

A bit your fault there I'd say for buying without thinking or reading properly but you can still try, maybe they will agree to take it back but you might need to cover the auction cost / shipping fee yourself.

I see no reason why you could argue about it as false advertising, obviously if it's been used then the key has been used and he needs to sell the whole account as it is.

Tru dat, but now that I've browsed other sales many of them say the keys have not been used - this particular item states neither way, and I'd consider it the seller's prerogative to protect himself against idiots like me.

Im sure if we were talking about following ebay regulations to the letter then you would not be entitled a refund. However, judging by the number and content of ebay related threads in general, I dont think you'd have much trouble getting your money back.

There are a lot of people selling MMO games with used keys, they are just selling box contents. You got a linky to the ebay item?

Does this allow people to view it? If not, the item number's 130412511618

Edit: No amtter how it turns out, I think the game kinda has me. I've never been able to conjure muffins before. If I can find a way to lightning-combo a mob down to minimal health and backhand it for a finisher, I'm sold.

The link had two 'HTTPs' but it was fine when I removed one lot of HTTP. So the thing sold for £5. As it includes the strategy guide, I think you did alright there, even if the code is already taken. Brand new WoW games (i.e. code not yet taken) seem to be going for the £15 mark.

Don't think the seller's done anything wrong tbh. Alright, he's not mentioned that the key's been used but he's also not sold it as unused.

Most people would state in the description that the key is used/unused to avoid potential misunderstandings.

You live and learn. :)

You can pick up WoW+TBC (or another battle chest) for a tenner from a well known internet retailer who's name I can't mention because OC also sell WoW stuff. :p

Ha! Winner - the seller was, unfortunately, lied to in turn. He's never played it himself, and was told by his seller that the keys were unused and still valid, but obviously never checked them. Now I've just got to pull the same thing off with the Wrath of the Lich King I bought at the same time, and I'm laughing. This description jst reads "POST AND PACK £1.00" - lack of imagination there.

I might pull my chestnuts out of the fire yet.

World of Warcraft - Battlechest is available for £9.99 inc shipping from gameplay
