Sisters Micra Problem

Hi guys,

I'm after a little advice with a car my sister has bought. Basically she passed her test last Wednesday and bought herself an 04 plate Nissan Micra SX with 39k on the clock from an independant dealer.

We took it for a test drive on Saturday and everything seemed great, pulled fine, stopped straight and true, all gears selected nicely, steering was nice and tight.

So it was delivered yesterday and after my sister had been out driving it for the afternoon she phoned me in the evening to say that she was getting a weird noise when selecting 2nd gear. I thought to myself shes a new driver in an unfamiliar car, maybe it's just the way shes changing gear. So I drove over and had a go myself. Whilst it doesn't crunch as bad for me as it does my sister, there is definately something not right with 2nd, my suspicions lie with a worn synchro ring.

What are my rights with the garage in regards to getting this fixed? When we bought it the guy said any teething problems bring it back and we will see what we can do, but I just want to know what I'm entitled to before I go to see him.

Annoying as the gearbox felt sweet on the test drive, but it was -1c and I'm thinking the cold gearbox oil being thicker than usual may have masked the crunching.

Thanks in advance.

Thanks for the link. She drove it again today and said it felt fine, I'm now not sure weather to try a gearbox oil change before telling the garage.

Your logic is a bit backwards, warmer box oil will reduce crunching and selection problems it would be more evident cold.

I blame your sister personally. ;)

Go back and ask them to change the oil see if it improves.

I phoned the garage today and stated the problem with 2nd gear. He was quite defensive saying that it wasn't present on the test drive (which to be fair it wash't, and I was in and out of 2nd a lot), and when he delivered the car 2nd gear was fine the whole journey (20 miles).

He agreed to take a look at it and my sister is going to drop the car off, but I feel he may try and fob us off with an excuse.

Do you guys have any advice at this stage of proceedings? I'll report back with his reply once I find out.
