So... my "new" car has some problems

Were you in the middle of a gear change whilst driving when it got stuck or had you left it parked in gear and then came back to it to find it stuck in the gear you left it in?

It's when I first start the car, when I'm actually going it doesn't seem to have a problem, it's just getting it going sometimes. Right now I'm taking it out of gear and starting, then sometimes it won't go in to any gear and reverse will crunch as if clutch isn't engaging. I can then sometimes jiggle the gearbox or turn the engine off which allows it to go in to any gear.

It's also started juddering a bit if I start the car in first gear with clutch down, it's like the clutch is only just engaging or something, it's very odd. I also noticed that sometimes when I do a cold start in neutral then push the clutch I can hear a noise, a sort of judder/crunch for a half a second and I can also feel it through the clutch pedal. Also, I might be imaging it but it seems worse on level ground :/

There is obviously something seriously wrong and I'm going to have to talk to the someone, the CAB? and see what my rights are then maybe I can get it fixed.

I remember refusing the extended warranty when I bought this golf, as I paid for a warranty before only to have a problem and I never got anything from them so I just said not to bother. However, on the invoice on this car it says "customer refused warranty" and I'm hoping this doesn't affect my statutory rights.

I'm so fed up with buying cars now, you can't trust anyone and in the past when I've tried to protect myself it was worthless so what's the point.
 
Sounds much more likely the clutch is at fault and not the gearbox after that explanation.

No chance on the warranty if it is the clutch and / or the release bearing..

"wear and tear item mate" is what you'll be hearing :D

At the end of the day it's a second hand car, by all means try and get some sort of payment from the trader you bought it off but I wouldn't be crying over it. **** happens.

But I've only had the car like 6 weeks, barely done 600 miles in it :/

**** may indeed happen, but having to potentially spend a 1/4 of the price of the car (if it is the gearbox) when I've only just bought it is surely taking the mick?
 
Within 6 months of purchase, the onus is on the seller to prove the product si fit for Purpose, meaning that if it went to court you'd have a massive chance of winning.

- Get another garage to inspect it
- Get onto your dealers with the fault
- If they don't play ball, issue a Letter before Action
- If they still don't play ball, issue a claim through the Small Claims Court
- You win, and get the cost of the repair, compensation and costs back.

This is why you should ALWAYS pay for a car on a credit card when you can. A guy on the MG Rover forum bought a 2004 Rover 45. It had random electrical issues 3 months from buying, dealer said sod off, and in the end the credit card company reversed the payment.

Keep fighting, you'll win I reckon. Perseverance. :)
