I have been told mavity has an effect on these due to the increased work the pump will have to do if you place it high above the CPU heatsink rather then Level.

Is this true, and is the difference an issue?

The reason I ask is I have to turn an NZXT x40 side on to get it to fit in my case
 
It's no different to any other watercooling system, but yes mavity has an effect, but it would need to be an exceptionally weak pump for it to pose an issue if the loop is contained within the PC itself, plus I would be pretty sure it'll be designed such that the fixed tube length is less than the distance it would take to cause an issue.
 
mavity should make very little difference, yes the pump has to pump the water up to the rad but this is countered by water coming out the rad and being pulled down to the waterblock.
 
The pump needs to overcome the static head of the loop to get going though, so if you have a total head of 0.5m and the pump can only do 0.4m then you have a problem. I don't know how good the pumps in these units are, but they're not great - but it'll be offset by the fact you can only have the rad so far from the pump itself and I'm pretty sure the pump will be able to overcome the worst case.
