A friend of mine recently had a run in with the police.

60 in a 30. She refuted the evidence of the TWO police offiers in the car and requested a court visit to protest her innocence. No extenuating circumstances.

She got home and discovered that the MoT certificate for her car had expired 3 months previously.
That's not the worst thing though.

She discovered that her Australian drivers licence had also expired and she hadn't bothered to apply for a UK one despite having lived here for 11 years.

So, what can she expect. I rekon a ban of at least 28 days and a heafty fine.
 
erm, its going to be a lot more than 28 days, from reading the local paper things like this are quite regular and id say she's looking at at least a year ban and a hefty fine

in court trying to give a defense of forgetfulness on just about all charges wont go down too well im afraid

You have no idea what the 30 was like, in the countryside there are often 30 limits which last around 500 yards and are half way down a wide straight road, purely because there are 1 or 2 houses there. Through these it is often fine to do in excess of 3 times the limit. I know at the last meet i went to a lot of us passed through a couple of 30's at this kind of pace, and i certainly would not consider it dangerous.

On top of the ban there would be a good chance of 6 or more points waiting for her when she passes her test and gets a licence :)
As some states in Oz require you to renew your licence every 5 years your friend should be on her third one by now!

60 in a 30 and moaning about it = 6 points

So that's a 12 month totting ban right there + fines if they throw the book at her for no MOT and possibly no insurance.

Why would they do her for no insurance?

Not this whole "you have no insurance if you don't have an MOT" nonsense again? :)
 
No MOT is fine, however I have no idea about no licence and insurance.

Since when you apply you have to state how long you've held one, effectively you've gained insurance by deception because you lied so it could be completely invalid.

Er her insurance would probably be invalid due to the lack of DL and MOT.

I would imagine that in reality she will have a 12 month ban and a hefty fine.
 
no liscence no insurance :)



tell her to take some lube with her its gonna hurt

expect at least 18 month ban if not longer and a HEFTY fine

basicallly its driving without a liscence poss no insurance and the original speeding offence,


best thing she could do is get a good lawyer and get him to present a good case

The license is a wierd one, I would guess it's not a very common occurance over here. I guess a lot will depend on whether it expired before she took the policy out or not.. if it did then it would technically be deception, otherwise she should be ok on the insurance front.. but still has the other offences to worry about :eek:

Hmm, if she never got a UK licence, she may have been driving unlicenced for the past 10 years...

I believe you must exchange your licence within 12 months of arriving in the UK if you wish to continue driving for more than 12 months. Although to be honest, I can't see her getting too wrapped for this as I'm pretty sure it doesn't involve a UK test.
 
TBH either way she's up **** creek and the only good advice to give her is to plead guilty at the earliest opportunity and throw herself on the mercy of the court with a plenty of apologies in the hope of getting a decent discount off whatever penalty they choose to inflict.
