Sofa Issue

Bought a sofa from DFS recently and just had it delivered today. At the showrom it was a 3 seater with a recliner on either side. We ordered two of these.

Now on delivery today we got two 4 seaters with the recliners on either side. I was taking delivery as im on a weeks holiday and to be honest with the England game coming up I was half cut and just wanted them through the door so just signed them off so I could watch the match.

Now the lass obviously noticed this problem and on looking back at the order sheet they had indeed put down two 4 seaters despite what we asked for.

Now I am going to see them tommrow, as far as I am concerned it is a misunderstanding and I just want them to take back the two 4 seaters and replace them with two 3 seaters.

But considering the fact that on the order it says two 4 seaters and I have signed for delivery can they refuse to exchange them? The 3 seaters were on display, we asked for the 3 seaters but at the end of the day it can come down to a case of he said/she said and they have all the paperwork.

Ultimately if they decide to be funny about the situation do I have a (legal) leg to stand on?
 
Bit of a thread revival here.

So I went to see the local DFS where I made the order and unfortunately they are taking the awkward road.

I spoke to the guy and he basically said "well it says on your order 4 seaters so unforunately you are stuck with 4 seaters"

He offered to check the system and if anyone else makes an order of the same sofas he will offer them to that customer and that will get it off our hands but basically its not very helpful to me.

I got a wee bit worked up so rather than arguing I just agreed and left.

I have e-mailed there customer support (no number, how typical) essentially saying I have two useless sofas and I want to exchange them.

For the moment I am trying to play on the law a little and say that they are not "fit for purpose" and so I am entitled to an exchange. I worded it nicely but if they play funny nuts I will word it specifically.

So all you keyboard lawyers does this have any real chance of sucess? As they are not "fit" for my purpose as they do not even fit my living room properly :rolleyes:

Only other option I can see is damaging the ones I have had delivered (they are still in original packaging so I could claim it was always there) and saying they are damaged I am not happy and I want something else. Though I would not rather do this because it is a sly and underhand thing to do :(

So advice me up some guys!
