When your xbox360 dies do you take it back to the store your brought it from or do you have to send it back to M$?

Also, when it dies do you keep the hard drive or do you have to give it back to with your console and if so does that mean you lose all the game saves and files you have on your HD?

I'd just take it back to the shop since the shop gives you a 12 month warranty.
