Speeding/conviction query

mainly aimed at Dangerous as he seems to be more knowledgable on the subject but anyone else with information is more than welcome to chip in.
after a disagreement with one of the LGV drivers at work i've turned to the forum to either correct me, or point me to a link(s) backing me up.

1.to the best of my knowledge, points (for speeding in this case) are on your license for 3 years in an active state, then dormant for a further year making four years in total.
if i'm correct in assuming this is the case can any of the members tell me what this final year period is for and what it actually means.
for example why not just say the points last four years and then they can be removed?

2.offence codes:-
the guy i've been disagreeing with says he's had SP10,SP20 and SP30 convictions on his license, although not all at the same time.
he insists i'm wrong in thinking that SP30 simply means speeding in a car and IIRC SP10+20 relate to heavy goods vehicles only.SP30 is purely for passenger cars.

as stated, any help appreciated.
if you lot can post any links could you possible make them official ie Dept of Transport or such like as these will be more credible.

Correct.

SP30 is exceeding the posted speed limit (20, 30, 40, 50 or NSL) so it is perfectly possible to get an SP30 in an HGV. Eg, 40 in a 30 as there is no specific speed limit that only relates to HGVs in a 30 zone.

SP50 is exceeding the speed limit on a motorway

really?
i thought that the fact the vehicle was a goods vehicle automatically meant the offence had to be SP20 or 30.

Edit: i meant Sp10 or 20

can anyone elaborate on SP20? it states this is for a type of vehicle excluding passenger or goods, so i'm assuming we're talking about plant machinery and the like?

also, can anyone address point 1 of the OP?

You are correct in saying that points remain on your license for 4 years.

The key point is that they only count for totting up purposes for 3 years. If you accrue 12 points in a 3 year period then you'll be banned.

Say, for example, that you got 3 points in Jan 2003, another 3 in Jan 2004 and another 3 in Jan 2005. By now you'd have 9 points on your license. If you were to get another 3 points tomorrow you'd have 12 on your license as they were all within the last 4 years but crucially only 9 of them would have been within the last 3 years and thus you'd not get banned.

ok, i'm with you so far.
wouldn't it have been easier for them to last for four years though or is there a conflicting reason for this "dormant" year?

you are given points, and they stay on your license for 4 years. Thats all there is to it really. The term "active" is just a misconception created by the totting up rule. The totting up rule only applys to points within a 3 year period, so some people refer to them as "inactive" or "dormant" or whatever cos they can no longer be totted up. You still have them though.

exceeding the speed limit for a caravan ie 60 on a 70 mph motorway

Could be difficult to get a concrete answer. There was a bit of row a while back as some police forces / courts were issuing SP60 codes when they should have really been SP30s. Nobody would take responsability for changing convictions, so if the people in charge aren't sure some of the time, what hope do we have?
