Just had a nasty surprise through the letterbox in the form of a speeding ticket from july last year (issue date was yesterday).
Checking the details there is a good chance I'm guilty but 6 months seems an awful long time to take to identify who the driver is from a hire car company.
I understand the 14 day rule doesnt apply if its a hire car but surely theres an upper limit to issue these things?

Points rather than an awareness course?
Does seem a very long time tbh I'd be questioning it myself tbh, that and can they prove it was you? not sure how this works with hire cars and tickets.

If it is WITHIN the 6 months then no, you don't have a case for a late NIP. However, if there was more than one person driving the car on the day it was caught, and there aren't any pictures available of the front of the car to help identify the driver, you may have a case that it isn't possible to identify the driver as so much time has elapsed. You have to be very sure of yourself if you take that option unless you want to be sharing a cell with Chris Huhne :p

I would strongly advise you get some legal help or at least some help from pepipoo.

From a bit of research online it seems to be that proceedings have to be commenced within 6 months of the incident (not paperwork received), however regardless you are still obliged to respond with who was driving the vehicle (if you can remember), failure to do so could result in a section 172. You may therefore need to respond with who was driving and contest the charge which would normally result in a court summons which would be invalid as it is greater than 6 months from the incident.

This is all based on tit bits of information on the internet and is by no means legal advice. Please do get some proper advice before taking any action.

I didn't receive my Court Summons within 6 months. Is the prosecution valid?

The Police have 6 months from the date of the offence to commence proceedings. This means that they have to file their papers within that period. There is no obligation for you to receive the Summons (Citation in Scotland) within 6 months and indeed, the Court will issue papers outside of that deadline if the file has been received in time. The Court will always confirm the date papers were received from the Police, i.e. Date Information Laid, so if you are in any doubt about the validity of the papers, check this date.

The papers have to be with the court within 6 months and as they share a computer system, that can be the case some time before the 'paperwork' has been completed. I remember a test case about it.

Sorry to hijack but is there a time limit once the court has received the paperwork to then contact the registered keeper of the vehicle in question ?

How many months do you have to wait to be considered in the clear etc 9,12,24 months ?
