Stuttery Xbox vidoes

Just a quick one, I've just downloaded the assassins creed trailer via xbox live and when I play it, it's stuttering so much. I can't see why it would as apparantly it's just playing off the HDD. Any ideas?

iirc some people had problems with this but an xbox update fixed it, is your xbox updated to the latest update?
