Suspended on full pay - Questions

My girfriend was suspended from work on full pay whilst her employer investigated an issue that happened in work.

She worked lots of overtime - about 80 hours a week for about 12 weeks prior to the suspension. Apparently her paid suspension has to include the overtime by law (I don't know how true this is).

My question though, on her next pay day is she still entitled to all her overtime that she is missing out on? Effectively having the same pay as last month or just her basic?
 
Your girlfriend should receive full pay + overtime that she has worked. If she is still suspended for the next month because she hasn't worked she will only get basic pay.

The best she could do is ring up and ask, it might be different policies at her work place??
 
are you asking if her employer will essentially assume that she would have continued to work overtime if she hadn't been suspended, and then pay her that amount?

If yes then no, that would be mental.
 
I'm probably going to regret this.

Her colleague and herself were forced to restrain somebody they care for.

Edit: I thought it was the average pay over the last 12 weeks.
 
I don't see what the issue is, as restraint I believe is okay, especially where there is risk of the person causing harm to themselves or others.

I suppose it depends on stories/witnesses, but I hope it turns out she was in the right.

might be like the SWAT thing whenever they shoot someone they are suspended with pay during the investigation regardless of the circumstances.

I imagine it stops them interfering with the investigation/influencing others.

That or she's about to be on another panorama special.
 
well, if she has been suspended on full pay pending some form of investigation then she will be entilted to her full pay at least. If they are fully aware she normally does a lot of overtime it might be decided to avoid any form of discrimination while she is on suspension to pay her a percentage of the overtime that she normally works (for example perhaps an average over the last 8 weeks) but this might not be company policy. I think you really need to find out what the policy in her company is to be honest. There were a number of staff suspended after an incident where my wife works and it took almost 12 months before it was all sorted out. Most of the people who were suspended had already found other jobs but were still getting paid full pay becuase they were on suspention it was a bit of a mess to say the least.
 
FWIW; suspensions do not imply guilt. They are merely used more often than not to cover the companies backsides when a lawsuit is possible. I wouldnt worry too much about the incident, if she has done nothing wrong the investigation will find so :)

Oh, and as per OP question - if the overtime is "salaried" then yes you are entitled, if you only work 37.5 hours salaried at 12K (for example), you can only expect to earn that 1K for the month. Any shifts you'd get extra cant be counted from my understanding.
 
I've heard of people that work (for example) a Saturday morning as overtime every week. After so many weeks of doing this, the employer is supposed to give them notice that the overtime will end and not just tell them they aren't required this weekend. Not sure how true it is or how it works.
 
She has to attend a disciplinary and is probably going to be sacked due to 'gross misconduct' because they were not authorised to restrain this person unless in life threatening situations. It is very messy at the moment.

So why did they restrain this person? Was the person having a seizure? Out of their mind on drugs/booze? Details man! Details!
