I did overtime last month, and did not receive it in last weeks pay- So I submitted a wage query.
They say there is now an overtime ban and they cant pay it me I have to have it as hours back.

I agreed to do the overtime when there was overtime and it isnt my problem that they arent allowed to put it through?? All I want is paying for what I worked

Can they do this?!

I did the extra shifts as 'overtime' not time in lui(sp)

TIA

this has happened to my friend at debenhams too. She worked a full weeks overtime and now they say she cant get paid for it, even though it states in her contract that she gets paid overtime.

They can't just spring it on you after you had already worked the hours.

They have! They said something about forwarding extra holidays to my uni store when I transfer - to me it sounds like fobbing me off to another store!!

I replied with Im not coming in next weekend as I need my money for uni, and now I cannot MOT the car as you owe me £200. (I need all the money I have atm for uni books and halls and tuition fees as no loan this year).

Call ACAS in the morning and get a difinitive answer.

It sounds really wrong to me. I don't know how these people sleep at night as I know that I couldn't. I can't treat employees this way.

i've only been at Tesco's 6months and i already know that when there is a overtime ban but they still want you to work extra due to other people on hols, or ill or just short staffed it normally means time in lui.........unless you asked and was told you would get paid of which then you should really see your union rep and Duty Manager. Then in future if asked to work overtime tell them to stuff it, lol they soon get the message. Although time in lui can be handy sometimes.

Its as bad as XL. SURELY the directors knew 6months ago it was fubared, yet they still took money from customers until midnight it went under!

Of course they did, they were still trying to put in place a rescue package, that's par for the course in situations like this (not saying I agree with it, but it's not unlawful).

As for the whole overtime thing, if your contract says you are allowed it and they haven't notified you in writing of a change to your terms and conditions of employment I would try to take this further (but get advice somewhere like the CAB or ACAS first as they deal with these things every day).

just to point out that if you'd handed in your wage query and they'd said "oh yeah, we owe you £200" you still wouldn't get the money for another 3 weeks.

Just take the time back ASAP if you don't need the extra cash for the next payday - if you do need the extra cash, keep going to work and try to sort it out, but it might take ages. Wage queries have to be in the first week after payday to be sure of getting the money next payday.

His contract probably says something along the lines of "if you work less than 36.5hrs in a week, you may be expected to work some paid overtime occasionally"

Yes but you don't just say "oooh it looks like we might not be in here in 6 months. Let's give up now and not try to save the company, our own skins and x number of jobs.. No we'll just give up now it's getting a bit tough". It's just the way business works. They tried to refinance, couldn't work out a deal in time and then at some point there has to be a cut off. That's just the way it goes sadly. Since people don't seem that keen on a socialist/communist Britain we have to run these things called companies that are supposed to make money and provide good services. Sadly, sometimes it doesn't work due to changing circumstances, bad management etc etc... It's life. Everyone feels sorry for the staff and the travellers but this is the way the world works. Sorry.

it's a store thing - when some stores are over budget, they'll cancel all the overtime on certain departments I think my store currently has an overtime ban for all departments except checkouts. However, they shouldn't be asking people to work overtime without telling them they'll get time back for it instead of paid.

the people who do all that sort of management are all in unskilled jobs though, so it's no wonder you get bad managers every now and then and they mess up and things like this happen.

just take it out of the till

my place is the same alltho there is a blanket ban on overtime
apart from when i suits them
which generally leaves us seriously understaffed some days i am the only forklift truck driver and i run goods in lol

We assume you are joking - but maybe confirmation of this would be a good idea.
There are some good ideas posted on these forums, there are some bad and stupid ideas posted on these forms (unfortunately more often than the good ones it seems).

This however would rate as lower than stupid.

I was delivering to Tesco's on Saturday night, two out of the three stores I visited were bemoaning the time off in lieu of overtime, its not like Tesco's are poor and can't afford it!

I shop at Asda!
