The dreaded letter!!!!!

Ok so I got a NIP through the door last week after my company had pre warned me it was coming. The offence happened on Dec 14th and when I checked back to that morning me and g/f were helping friends take boxes from old house to new. We must have drove up and down that road about 10 times so not sure who was driving, we also never spotted any camera vans at the time but that’s another story.

So I phoned the camera partnership and they said that it was a forward facing camera so we can identifying the driver, they said they would send me the photo, excellent as I’m not taking the blame if it's not me and vice versa. Letter turns up today with 3 different photos all of which are shocking quality, you can just make out the car but cant make out anything else, now we are back to square one.

If it was me then I would hold my hands up and take it on the chin, the fines not a problem as it's obvious someone was speeding, but it’s the points we are arguing over.

Has this happened to anyone and what did you do, The girl I spoke to on the phone said it would be perverting the course of justice to wrongly name the driver and they also need the NIP back within 14 days :eek:
 
Don't quote me but I think you basically have to prove that you have made a decent effort to identify the driver at the time of the offence. If you do then they will throw it out in court.

If you were both driving intermittantly on that day and have requested the pictures but they are not conclusive, then I dont see what else you can do - they can't convict you both on the off chance it was you so realistically i'd have thought you would both get off.

Only down side is that you may have to put in a court appearance which of course wastes time, and could ultimately end in a harsher sentence if you have not told the truth.
 
i recall when i had a similar situation (going back a few years now tho...) they didnt care who it got planted on, just wanted a driver number to fit the points too :eek:
 
As far as I was aware, they can't and wont give you points if they can't prove who broke the law - but to get to that point you'd have to go to court and prove a) it's indistinguishable and b) there is a good chance it would be anyone. That shouldn't be too hard in either case - remember "Beyond reasonable doubt" still counts here. You will get the fine as the car owner, but the points wont be awarded. The fine might be larger as you'll incur court costs.

This is what I believe to be true - so if anyone knows different for sure, then I bow to superior knowledge ;) I've only been done once, that that was by an unmarked following me :(
 
cheers for the replys, might have a word with lawyer as the 14 day notice doesnt give me much time, I always thought they used decent equipment to take photos, my phone could take a better pic :rolleyes:
 
if the offence was on the 14th december surely its far too late for them to be sending you the letter and they should let you off :D

It is 14 days they have to send the stuff though isn't it?
