He nicked the phone, not the charger.

Just sort it out like adults, calmly explain the situation to him again just now, apologise again, and if he still doesn't give you your phone then go to the manager. Like someone mentioned earlier though, you're both going to look like squabbling kids to your manager.

It's not on his desk, it's not in his draws and he hasn't planted it in mine. He's carrying it in his pockets - I'm not going to go through them.
 
I wouldn't get the manager involved, even though you are in the right it won't reflect well that you cannot resolve a petty office squabble on your own.

Personally I would have asked him to come outside the office for a word, don't escalate it infront of others. And then talk straight to him, demanding the phone back and explaining when exactly he will get his reader back.

He's not a small bloke, but not a big scary one either. To be honest, Phate wouldn't scare me, and I'm a weedy little git. :D
