This is my build ive gone for.

Yeah I agree, if your after more than 1 opinion :P

If you feel your over budget though you could drop the i5 down to the non-K version and skip an aftermarket cooler unless you prefer something more quiet.

I think I remember reading somewhere that once you add the fan in you actually need 173mm of space for that cooler so I think the only way it's going in is passive :(

so what cooler to go for then.
the last case I had was an nzxt phantom 410 and the cooler in that was arctic freezer pro 13 and that fit is this the sim size.

Shame you can't stretch your budget to get a AMD R290 or a Nvidia GTX780. I assume you are buying a PC build for gaming, and the Graphics card is the single most important item to get.

That`s not correct, the fan is not the problem. As RJC pointed out, the ends of the heat pipes protrude about 11mm above the fins and fan. You can see this in one of the pics in the product info.

I appreciate the heatpipes might extend beyond the 160mm but to me it looks like the fan extends even further than the heatpipes?

Stulid did a pretty awesome review of it here and several of the pictures make it look like the fan is the tallest bit. http://forums.overclockers.co.uk/showthread.php?p=25274565

Either way, my point that in total it stands at 173mm and thus wont fit seems to be correct.
