Training Agreement

Morning All,

I have a Training Agreement with my employer which terminates after 18 months of 'Passing the exam'.

My final examination date was the 23rd February 2016 and I perceive this to be the examination pass date. Results were released on the 7th April 2016.

For some reason the ambiguity of my agreement had me thinking that it could be argued the pass date is the result release date rather than the examination date but on reflection having written this feel a little more confident.

Does anybody else agree/disagree with my train of thought? I have not given notice to my employer yet but am likely to at the end of this agreement and preferably would like my notice to coincide with this term.

I'd say the 7th as you haven't "passed" until you've got the results, although the only people who will know for definite how they interpret it is your company. I imagine legally it could be argued either way.

See this was my original logic. Then again all the work is done and the exam technically finished on the 23rd February and it just takes 6 weeks for it to be verified & official.

I'll take a look and see what the professional bodies online portal says as to the 'exam pass date' to strengthen my perspective.

Exam date: 23-Feb-16
Result: Passed

Not really that helpful :p

Most would argue there's little in it with the final 3 months of the term costing me between £700-£300 as existing modules agreements terms expire. Though collectively over the last 2-3 years the total cost is circa £10k~ and knowing the company well wouldn't put it past them to get funny about it :o

If push came to shove it's pittance and wouldn't let it keep me if I did want to leave but equally as a matter of principle believe the day the exam is sat is the day the work to pass is done.
