Tried to get a replacement!

Hey guys!

I tried to get a replacement 360 today from Halley's and they didn't give me one. My 360 isn't fully broken though, it just crashes all the time!

They said they can get it sent off to Microsoft to get it fixed which i declined straight away, the guy who worked there who i actually went to school with said they usually just replace the hard drives. I couldn't believe the guy wouldn't give me a replacement as he was actually a friend!

I whipped out a copy of the sale of goods act to which he then chuckled and said he gets this all the time, he stated that Halley's work closely with the sale of goods act (eh?) and they say that they can use there store policy.

I read through some points on the sale of goods act which override what he was saying to me but he just said my computer wont let me.

I then proceeded to ask for a refund as the replacement wasn't option to which he had a look on his computer and also said it wouldn't let him.

At this point i thought he was lying.

He pointed out on my internet receipt invoice that i have till tomorrow which is the 12th to go the Microsoft route but this was wrong as i received the 360 on the 15 last year. He said that Halley's go by the purchase date of the product not the day the product was received, this to me sounds stupid! Say if someone ordered a 360 and it came a month later and it broke within a week, according to there policy he wouldn't be able to get a straight replacement as he is outside the 30 days because of the purchase date that they go by. Just seems stupid!

I'm not one for confrontation or any hassle so i declined the Microsoft route and went.

Anything else i can do?

Can i extend my warranty now?

I even bought a Memory card which cost me 22.99 before all this! What a waste of money!

If i cant get a replacement I'm gonna get a CD lens cleaner and a Air Spray to clean it out. May even open it up!

That's probably what they are counting on, I would have waited there all day until they sorted it..or called the Police. But then I love doing that kind of thing anyway as long as I know my rights. Unsure where you stand legally but you seem to have done your homework so to speak.

How old is it?

Its not broken as such, it just crashes a lot. Its crashed on GRAW2 5 times already and i haven't even played it today.

I just don't want to send it away to Microsoft and get a bad refurb that'll break!

If mine does break I'm not buying another, think ill go the PS3 route!!! :eek:

I'm not an expert on the matter by any means, but that sounds like an absolute load of turd to me.

The Sales of Goods act is there to for everyone to stick by, you dont "get friendly" with someone and then get away with everything

Tell him you've heard more sense come out of your bum in the morning and he has to stick to it, or get proof that they are exempt from the Sales of Goods act

Ring MS, tell them it crashes a lot. They will replace it.

But the SOGA trumps store policies, as it expressly states within the act itself. But if you have a few days left then get it sorted under warranty. GRAW killed my box as well, exactly as you describe, but unfortunately I was 2 months the wrong side of warranty.
 
My Xbox 360 has been doing the same thing, keeps crashing in GRAW 2 and is pretty much a year old (purchased on 28th March), unfortunately the company I purchased it from have closed down.

I ran Microsoft today, told them what the problem was and gave them the machine serial number, they gave me a reference number and told me to try playing without the hard drive attached, I tried this, and it crashed again, so I rang them back and they agreed to get someone to collect the Xbox so it could be repaired / replaced.

They never even asked when the machine was purchased, which surprised me, however they couldn’t give an exact turn around time.

Not as severe as that!

It crashed repeatedly on Rainbow six also quite abit, i resorted to not signing in on live (unplugged the ethernet) which seemed to fix it, never crashed ever after i did this?! :confused:

Seems software issue?

I find the booting up of mine and guide usage to slow up / crash if im downloading and abusing all my bandwidth the lage seems to kill it, it signs in instantly with no ethernet plugged in

Did he cough in your direction after saying this? Reminds me of the travel agent women off little britain "Computer says noooo - cough" :D

Did feel like that, seems like everyone nowadays seems to rely on computers too much!

If my 360 does actually break fully in the future I'm definitely going the PS3 route.
