Right - you may remember a few months ago, I slipped on a wrongly-positioned manhole cover and did my neck in?

Well I've only just got back to work the other week and I'm nearly back up to speed...A couple of people have asked what's been happening so here you all go:

After doing a bit of digging, it has been discovered that the plans and specs provided by the council called for a cast manhole cover (the nobbly steel ones seen on paths everywhere) and the plans have a note saying "Must be non-slip due to position of cover on walkway." (or words to that effect; I'm not at home atm so can't quote verbatim).

The work was done by a third party contractor who have accepted blame for not doing the work to spec and fitting a non-non-slip pressed aluminium cover.

We have just declined an initial offer for settlement before moving to court proceedings (advice given by my pet legal eagle...) and we have a meeting tomorrow afternoon at 2.

So...Fingers crossed for tomorrow.

Good news - my guess is having been off work for say 3 months you're looking at ~£5k total damages (say £2-3k LOE, £2-3k generals), want to start a sweepstake? Nearest person gets a grand? :p
LOE = 4.3k min. plus my employer decided to let me go rather than keep me on SSP for so long...So I had to jobhunt again.

Did you have to sign up for a CFA with ATE etc? If so I suspect the solicitor is rubbing his hands with glee, add another 25-40% to his fees recoverable from the insurers!

Solicitor is marrying my sister next year...That's why I decided to go ahead. :) Known him for about 6 or 7 years now.

I should add that I took advice from him but used one of his colleagues for all the bits and bobs. :)

By mistake. Thread URL was quoted to me by a friend.

Charmed that you feel the need to discuss me but seriously, get over yourself.

As for a follow up, we declined the second offer (about half of my LOE) and noted that we would proceed with matters via the courts. Two hours later they called my man back and made an unconditional offer of LOE plus a tidy little sum which we accepted.
