Upgrading from Windows 7 to Windows 10

Afternoon

I have a HP Windows 8.1 Pro Desktop where I installed Windows 7 Pro with a different license.
I now wish to upgrade to do an in-place upgrade to Windows 10. I believe the free upgrade from Windows 7 is no longer available.

Will Windows 10 setup detect the Windows 8 license from the BIOS and allow me to do the in-place upgrade?

So, I guess the question is does the Windows 10 setup file check the installed OS license or the BIOS license?

BIOS license takes priority.

I am shocked this hasn't been answered already. I don't know what's going on with this forum. Anyway it probably should activate as I done a couple recently and they just activated with a digital bios licence.

The free upgrade from 7 to 10 is still running as far as i know.
