Using DS Download play on planes

Is using the download play (not WIFI) allowed on planes?

The download play is still using WIFI, just using Nintendo's own protocol... its using exactly the same hardware inside for an RF transmission, so whatever rules for WIFI on planes will still apply for that...

I can't remember if I read this or dreamt it, I'm having real bad difficulties with my memory lately, but I don't think you're allowed due to it broadcasting a signal. Like I said I could be wrong and may have been drunk when I heard/read it or made it up.

Its in the manual that you shouldn't I think. And no you shouldnt use it with wifi on, on an aircraft. Not that it will do anything they just want to get their own stuff up and running and flog it to you.
