Just had to get this one off my chest, sorry
2 years ago I was involved in an accident in my Beetle - driving down a slip-road onto a dual-carriageway one morning, the DC was clear next to the slip road so the cars in front on the slip-road and myself were clear to merge, I looked in my wing-mirror, saw there was an Escort van approaching and watched him signal and move over so we could join the DC. I then looked up only to find that the car 2 cars ahead of me had decided to stop at the dotted white line at the end of the slip road
The car between the stationary car and me (New VW Polo) had to do an emergency stop, I attempted the same but I hadn't a) left enough room and b) noticed the car in front stopping early enough, and I shunted the Polo, meanwhile Mr. Hesitant joined the DC and continued on his way oblivious
Anyway, we swapped insurance details, I admitted liability as there wasn't much else I could do and informed my insurance co. later that evening. That was January 2005 and I hadn't heard anything else until yesterday when I got a claim form through from Kendal County Court for ~£250 damages resulting from that accident
I just called my insurance co. from back in 2005 and apparently they wouldn't pay out all of the 3rd party's claim as part of it was for a hire car and they judged it to be excessive, apparently you're obliged by law to "mitigate" any expenses and basically keep them as low as possible. So now the 3rd party has filed a claim against me personally in court, I've got a load of paperwork relating to my earnings and how I'm going to pay the money
Basically WTF?! I didn't know you could even do that kind of thing, I've faxed a copy of the court paperwork through to my old insurance co. but I'm slightly perturbed, according to the court papers I'm supposed to reply within 14 days otherwise they'll make a judgement.
What happens if my old insurance co. don't reply on my behalf on time, is there anything else I should do in the meantime?
