Vsync and ATI

I had a read about this being a microsoft problem not allowing drivers to take control and force Vsync. Its up to the game 
oh god, thats why I get all this tearing on my new moniter :/
Symptoms:
When setting Wait for Vertical Refresh to "Always On" in Catalyst Control Center, Vertical Sync (Vsync) may not be properly forced in game.
Cause:
The cause of this issue is not yet known.
Solution:
Currently there is no solution.
ATI Engineering has been advised of this issue and is investigating. Any updates will be published when they become available.
