Waiting for 28 days for rma replacement???

Hi guys, i RMA'd a XFX GTX260 28 days ago back to ocuk, and still not heard anything. My account still says they are waiting for a replacement from XFX. But as XFX no longer deal with nvidia or that the gtx260 is no longer in production it will be a long wait.
Really what i would like to know is what are my rights in this matter? Can i ask for a refund or credit note even though the card was over a year old?
Or do i ask for a new replacement of same value? Or just be forced to wait it out?
I find that having to wait 4 weeks for a replacement to be unacceptable, I know this isn't overclockers fault. But surely they must have regular dealings with XFX rma's.

you may get a card for similar value back or get a refund for its current market value i think.
 
1 month sounds reasonable under the circumstances.

I dont see you having any other options. I cant see taking it in writing to OCUK garnering a different result, or any quicker. I cant see a magistrate being interested, as I dont see any law or consumer right being broken here.

1 month for repair/replacements is a normal 'maximum' for this sort of product. There is no suggestion of a product not fit for purpose at the time of sale. You could reject/postpone the RMA and seek an independent engineer to write a report detailing a fault always present from the time of sale, and then try and persue OCUK. But OCUK would still have a month to deal with this. Worst scenario there being 2 weeks to answer your letter and deciding to send it away for a 1 month repair, and then you having to write it again to claim independent engineer costs back. Best being 1 week to answer your letter and deciding to replace it with their own stock for a <2week total turn around.

As i said in my op. I know its not ocuks fault. But one of the reasons i bought the card was because of the warrenty, and the fact overclockers deal with xfx's uk rma's.
I do think 28 days is unacceptable. If you bought a new car with a 2 year warrenty and then had to wait 4 weeks why it as in a the dealership for repair, you would be annoyed.
Luckily I was able to buy a new card. But it could have be a young kid who saved his pocket money up, and now cant use his pc.
I dont want to go to the lengths of letters and reports. I just want a replacement or my repared card back. I feel that this is my right as i origanally paid a premium over the lower cost cards for the warrenty and rma service.
 
You can get something of the same current value, a replacement for the current product, or something acceptable to all parties involved. 1979 sale of goods law 1982 sale of goods and services act. just google them and you will have all the info you need. OCUK have supreme customer services, just ask them for the same GPU from a different company, or ask them to refund the current value for a similar card and buy another one.

Cheers Cleeecooo, Just what i was looking for. Totally agree with you. OCUK do have a really good customer service. I have recomended them to several friends.
 
Did you get any results here?
I'm in the same boat , sent my 4870x2 back to Oc Who tested the card the next day and let me know the card was borked. Its just coming to the 28day mark for me but still not heard anything yet. My main prob is I haven't got another card to use:( Just wondering what they might send as well.
 
If you've found yourself waiting for a long time without hearing anything about an RMA I'd suggest you post in the Customer Services forum or (preferably) give them a call and check out the status of the RMA.

I had to send off my Dads 4870 in September and they immediately forwarded it on to XFX. Kept in touch via the forum, and although they couldn't give me any details of how the RMA was progressing after ~25 days they suggested I give them a call. Did so, and a replacement was winging it's way to me.
 
Hi guys. I sent them a web note on friday saying that 28 days had passed. Overclockers replyed saying that its 28 working days not 28 normal days untill they can look at other options. i hopefully something will be sorted by the end of the week.
 
28 days thats nothing :)

I waited 3 months for a competitor to sort my situation out.

Its amazing that you can buy any kind of product from any type of shop & refunds/replacements can be almost instant or least within days to a week. But not computer hardware, this stuff takes 1-3months to sort. Customer's been taken for a ride.
 
In fairness my new GTX 470 turned up borked on Friday.
Sent it back monday and have new card in had this morning.
 
When I RMA'd a XFX 260 I believe it took around 5 weeks for OC to get me a replacement (which was an evga GTX 280). Wasnt happy at the time but as said, it cant be easy having to deal with XFX and then sort out a replacement from OCUK's end.
