If a manufacturer contracts a courier to pick up your stuff for a warranty repair, and the courier then breaks your stuff on the way to the manufacturer, do you have any legal avenue to claim compensation from the courier?
The gf is being messed around at the moment by Acer: Under specific packing advice from Acer, she packaged a laptop in a jiffy bag with lots of bubble wrap, then DHL came and picked it up. Acer are now saying that because it arrived with a cracked screen, she will have to pay £86. DHL are saying that Acer can claim this cost from DHL. Acer are denying that they can claim, because it wasn't packaged exactly as according to the warranty document (they told her to just send it in a jiffy bag).
Where does she stand? DHL broke something that was adequately packaged, and Acer are refusing to claim from DHL for this, because it wasn't packaged to *Acer's* recommendations, which are different to how they advised her to package it. Unfortunately, she can't prove they advised her of this, because she didn't record the phone conversation where this happened.
