You may get a GTX280 from b grade, or a refund, or they send your card to manufacturer

Depends on the stock they have left. Returning a 280 is likely to yield another 280 IMO. Someone returned an 8800GTS 640mb and got a 9600GT back, because that card has been EOL for quite a while now.
