got an asus p5k-e tried to update the bios via windows, not i switch it on it the comp starts for 3 secs then stops and this keeps going. ive tried resetting the cmos and taking the battery out, any ideas?

If you'd have a bad BIOS flash and resetting the CMOS doesn't work you may have to obtain a new BIOS chip from Asus. I had to do this a month or two ago.

take the cmos battery out and remove the power lead from the pc aswell has worked for me in the past worth a try plus leave for a few mins

nope not worked, can i just not send the motherboard away for RMA? or return it as faulty? i only got it yesterday?

You've should do the

"I woke up this morning and turned my PC on and it wouldn't boot. It worked fine yesterday."

routine and get it swapped. hehe
