I ordered a bed on ebay on 6th Jan, it looked nice in the photos and the seller had good feedback saying they were well made. The seller contacted me stating that they were all hand made by him so there would be a 4 week wait on delivery.
Anyway, the bed arrived at the begining of February, but it had been damaged in transit. I contacted the seller immediatly and he agreed to repair the damage if I sent it back to him, but he wanted me to pay for the shipping. Because of the large size of the item, and it costing almost £100 to ship it back, and because as a company it was his responsibility to pay for the shipping cost I made the point that I should not be expected to pay extra for goods damaged in transit. I also stated that he should be able to claim off of the courier for the damage.
I didn't hear much for a week and then he replied stating he had come to an agreement with the courier company and they were going to send me a cheque for £100 to cover the shipping return of the item. I thought this sounded a bit dodgy because their contract is with him and not me but accepted it because it seemed fairly genuine.
A week later I hadn't heard anything so emailed the seller again, he said he would get in contact with them last monday and find out what was going on. I still haven't heard back from him about it, and I have logged into ebay to find that he has now got 2 negative feedback from other people who are having the same problem with the same item.
I wasn't too worried until just now, I kept logging into ebay and it stated I had 60 days to open a dispute, so I thought I could get a refund through Paypal up to 60 days from the transaction date (being as they are owned by ebay so I assumed their policy was the same), it turns out its only 45 days for Paypal. So now I have waited too long to get a refund through Paypal, and appear to be completely at the mercy of the seller who is leading me on a merry jig.
What are my options?
