I have a family member who is abusing his mother's disability badge, using whilst she's not in the car or he's not picking her up etc.

We've confronted him 3-4 times, even removing the badge from his possession and returning it to it's rightful owner however he's just gone and got it off her again (she's 94 and doesn't put up any resistance). His response every time we confront him is "I don't give a excrement"

Thing is, he's using it whilst he's at work to park up on his breaks etc (he's a taxi driver) to get free parking. Today I saw his vehicle parked in the local hospital in the disabled bays but knew for a fact his mother was at home as I'd just spoken to her announcing the birth of her great-grandchild.

The only real option we really have left is to report it to the scheme's local council office but this means that the rightful owner will lose the use of the badge.

Is there anything we could do to prevent this? Would speaking with the taxi licencing office yield a better result?

Reporting it to his employer isn't an option, he's been reprimanded several times over poor standards of his drivers and does nothing about it.

Might be worth finding out who the local community officer is and asking him to have a chat with him. Or find a local policeman to have a chat when he's parked up illegally.

Just found this:

Misuse of genuine badges. This means using the badge when the holder is not present. Some people who fall into this category think (wrongly) that what they are doing is not fraudulent. A few will have failed to understand the restrictions on use, but most will chance their luck on the basis that it can be hard to prove. Either way, this is still a criminal offence; it can lead to prosecution and a criminal conviction.

Emphasis mine. Find a friendly policeman to have a word.

So you want to get a family member maybe a conviction and a fine. He will get found out at some point I would just leave him too it.

Who drives the mum around when she needs it ? If he's the only one doing it then she suffers if the badge gets taken away. Much as the guy sounds like a selfish **** there isn't much you can do without affecting her. Is there no other family member who can take the badge and driving of the mum on when its needed ?

If mum is 94 then he must be old enough to know better, so even a "quiet word" from police will likely get ignored.

Why do you even care so much? No one is getting hurt over this whereas your white knight crusade is likely to cause issue for the wrong person. Get on with your life.

If you report it she will probably lose the badge. If she uses it a lot then she will be the one to suffer so you should think very carefully about the consequences of reporting it. At 94 I don't suppose she will need it for too much longer...

In a twist of fate, this morning when I went back to visit my partner and daughter I got wind that the hospital had reported him with CCTV footage.
He was given a warning as he needs to be caught in the act but if he is caught he'll be looking at a fraud conviction.

Unfortunately the chances of them getting caught are very slim unless they are reported most councils/police forces don't have the resources to Police Blue Badge abuse/fraud, so they rely on people doing the right thing and reporting possible abuse/fraud.

No-one getting hurt.........what about the disabled space/parking space they are taking up that could be used/needed by someone that does actually have mobility issues.

At no point did the OP mention the person parking in the only available space causing issues for others. Let's not go making up hypotheticals for the sake of bickering.

Let me clarify. There are only twelve disabled bays for the hospital. A hospital that has already been deemed 'too small' for its catchment area population (and yet the council still allow developers to build more house despite the lack of amenities & services but hey the brown envelopes are well stuffed)
It's extremely rare to find an empty space even in the normal car park.

As for the question of him getting a conviction. We've tried to get him to stop without taking tht step. He will not listen. He's one of those people that's "always right no matter what".
If it takes a criminal record for him to realise then so be it.

As stated above. It's out of my hands now as the hospital have already reported it to the relevant authorities and a verbal warning given.

The OP stated quite clearly that the person is abusing a relatives Blue Badge that by definition means that he is using it to park where he isn't entitled but somewhere a disabled person is..........

Usually these people will eventually get found out on their own, I worked with a guy who had a disabled badge for years. One day he came into work complaining he'd had it taken off him and had been fined for it. All I could reply with was "serves you right you daft old git" :p

Various members of the public can be quite salty about disabled parking so if you get out of the car and aren't in a wheelchair or on crutches there's always someone who will look at you like there's nothing wrong. This I bet is where these anonymous tipoffs come from.

Exactly.

My sister suffers from a back issue where some days she can't get out of bed without help.
Some days she is seen to be fine.

Someone reported her because she was able to drive and go shopping.

The courts fined her, stripped her of her mobility car and then ordered her to pay back her disability allowance.

All based on evidenceshe could drive and carry shopping... when she was granted a mobility car lol....
