Ok so I have just got a taxi home from work.
At one point the taxi driver answered his mobile without a hands free kit and I told him to hang up but he ignored me.
I told him I was going to take a picture of him using a mobile phone which he actually posed for.

We then got to my house and I told him I wasn't going to pay the full fare because of the fact he broke the law. He said he knows where I live and is going to report me to the police because it is a criminal offence to not pay the taxi fare.

Surely though if he is using his mobile phone while driving he is putting me in danger.

where would I stand if he does report me to the police???

two wrongs don't make a right young padwah.

at the end of the day why should I pay the full price if he is going to put my life in danger.
I try as hard as I can to live on the right side of the law yet he should be paid for breaking the law its a sad sad world we live in if that's the case.

I'm just scared because I know what things are like at the moment knowing me I would probably end up in court with a big fine. I would just like to know if this could happen?

Why even pay him any money if you feel that strongly about it?

And you have literally no evidence of a taxi driver taking you home and using his mobile phone apart from a picture you have taken of some random bloke in a car while holding a mobile.

because he was nearly at my house when he answered and I couldn't get out because it was a black cab an he had locked the doors

Could have just said "It's ok mate actually, this is ok." Payed him then been out of harms way.

So I am weird for trying to stand up for myself??

Well, yeah. If, judging by what you've said, you were nearly home and he cracked out his mobile; you were obviously locked in the back with mere minutes before you were at your door. Why not just sit there as per any normal taxi user, pay your fare and be home?

Sounds like you're just being a needless law-stickler. Sure, it might be wrong but what kind of outcome did you expect?

As if talking WITH a handsfree kit is much safer...

What would you do in this situation
I would have minded my own business...

Do you tell a driver to shut up when he's playing with his radio while talking to another passenger too ?
Have you ever driven a car actually ?

driving while having a using a mobile phone with the other hand is illegal Fact no ifs or buts.

No offence guys but I'm going to leave it I'm not going to get any good advice from here even though I thought I would.
I will just leave you with this what would you do if you were in a car accident cause by some driver using his mobile and you were the passenger??

So?
I don't care.
There are more silly laws out there. Would you stand in the bushes with a radar gun photographing cars that drive too fast too ? Or when you're driving the top allowed speed, do you report cars that overtake you for speeding too ?

What advice do you want ? You'll probably be fined or have a visit from bailiff for not paying the taxi... Or, you might get away.

Why would I be in a car accident if someone uses his phone ? I'd hope I'd be alive, then I'd be mad at the driver for not paying attention, NOT for using his phone, or if it's a minor accident, I'd laugh my *** off at him for being stupid and damaging his car... Honestly, I don't think handheld phone calls are any more or less safe than handsfree conversations, both distract... A driver that can't steer with one hand should not be driving.
