This is the reason for insurance - refusing to use it does not mean she is obligated to buy a new one. I would not wish to ask for anything if I was covered by insurance and if not covered, I would ask for a repair. If data is lost then that is simply foolish - we all know that backing up data is a MUST.
All in all - claim on insurance - if you feel you should pay, then repair is only way to go.
Rather cheeky to ask for a new one when they are covered - maybe offer to pay the extra premium on the policy, that would be equally as cheeky
