Hi all,

Been reading over at ThinkBroadband, a few ppl over there are saying if your not migrated away from AOL by the 1st Feb, then your going to have to pay off the rest of your contract still, as if you connect up on the 1st, then that means you have accepted the new T&C's, but surely if you have requested your MAC, and had your order confirmed then it doesn't matter, as your order has been confirmed long before the 1st Feb, so anyone know what the deal is.

Theres also ppl saying they are disconnecting before midnight 31st, and not logging on till they have been migrated, thus not accepting the new T&C's so not having to pay it off, but how are they gona know they have migrated, as for me UKFSN said i get e-mailed, now yeah all well and good, but how am i going to know if im not on the net, and with being on a router, soon as i turn my PC on, my nets on, so if its right then im going to have take all of my AOL details out of my router to stop it connecting to them when i switch on, and then on the 2nd when my migration is going to happen, im going to just have to keep putting in my UKFSN details until i connect onto them, but surely thats not right, if you have had your MAC before the 1st Feb, and had your order confirmed before then, then surely they cant make you pay the rest off if your migration is a day or so after the 1st, so anyone any ideas.

EDIT: Actually thats a load of guff if you think about it, it doesn't matter if you don't connect after the 1st, if you aint been migrated, you still on AOL till your switched. :D

Still not sure on the other point though, about getting charged for the rest of your contract still, even though you have had your MAC, new order etc... confirmed long before the 1st Feb, surely they can't charge you the rest still. :confused:

Well according to the AOL agreement :-

Changes to this Agreement
If AOL makes any significant changes to this Agreement then we will notify you at least 30 days in advance. If you do not agree to the changes, you may end your Agreement by notifying Member Services on 0870 320 2020, or by email sent from your master account to [email protected]. We must receive notice from you within the 30-day period. If you terminate in these circumstances during the 12 Month Commitment and are on an Annual Plan, then AOL will refund you for the balance of the Minimum Term from the effective date of termination. (The effective date of termination will be the day before your next billing date after you notify us that you are ending this Agreement). AOL will not refund any charges to you if your Agreement is ended.

To me that says, if you tell them you don't agree, and you are leaving so want a MAC code to do so, then you have told them within the 30 day period, so therefore you do not have to pay off the rest as they say as you have given them notice within the 30 days, or am i missing something.

Not if your on a monthly contract i dont think, ive still got 7 months left, so will cost about £175, but im sure seen as ive gave them notice that i dont agree, so am leaving within the 30 days (done it last week), then therefore i do not have to pay the rest off, even though my migration is taking place on the 2nd Feb, as it was all confirmed last week, so AOL will know, as surely the new ISP will contact them about the migration from their service.

Tho you did have plenty of opportunity to get migrated before the 1st.


My UKFSN goes live tomorrow :D

I did yeah, but i gave them the notice within their 30 days that they said you had to do to not incur any penalties (i.e pay the rest of contract off) that i was not accepting the new T&C's, and so i was leaving.

Hope it goes well for you tomorrow. :)
 
CPW have changed the T&C's, theres an FUP with 'traffic management' (aka shaping) starting, and they are allowed to give out your details to 3rd parties, and install tracking cookies on your PC to track where you go etc... so if you look online at say mobile phones, they can pass your details onto mobile phone places who will bombard you with mobile phone offers etc..., new terms of use are here , and the new privacy policy about them being allowed to pass on your details here, all starts 1st Feb. :)

They sent everyone 30 days notice, 30 days ago lol, so if you want to go without penalty (i.e not paying off rest of your contract if in one), then you have to give them notice within those 30 days, so you have about 2 days left as changes take affect on midnight wednesday 31st.

Woohoo nice one :cool: , getting switched on Friday me, i can get about 7.6mb on MAX, as AOL put me on MAX for the free upgrade to 4mb seen as theres no Gold now (which im on), and thats what im connecting at, mind you im still on the 2mb with AOL when i should be on the 4mb now, but i think its got something to do with the software which im not using, as when i got regraded from silver 1mb to 2mb Gold i had to put the software on and connect with it to get the 2mb speeds, as i was connecting at 2mb, but still only getting 1mb.

I phoned them up and they said the switch had been done, so it came to about 5pm and i thought sod this im gona install the software and have a look to see if my package has changed, as when you use the software, it says wether your on silver/gold etc..., so when i connected up with that it said i was on 2mb gold, so ran a speedtest, and sure enough i was getting 2mb speeds, so i thought id have to connect through the software to get it, but no, i tried my own connection again instead and i was still on 2mb, so i dont know how the software activated the 2mb, as i was getting 1mb speeds still all day before i tried the software, so if they think im going to go through the software to get the extra 2mb for 2x days then they can **** off as its UKFSN on Friday for me. :D

Did you have any issues connecting at all to UKFSN, or was it just put in the username/password, the DNS primary/secondary jobs, and that was it, hit connect and voila. :)

Well just ran the BT speedtester out of curiosity and got these results

Test1 comprises of Best Effort Test:
IP profile for your line is - 6000 kbps
DSL connection rate: 448 kbps(UP-STREAM) 7392 kbps(DOWN-STREAM)
Actual IP throughput achieved during the test was - 1903 kbps

Been reading over at ThinkBroadband about someone else still on 2mb even though he's on his 12th day, he phoned AOL and they said he can't get more than 2mb on MAX, so looks to be the same for me, as he said his neighbour is on the 4mb now, so when i get on UKFSN on Friday all ill get is the same 2mb MAX, or its AOL having us stuck still at 2mb, as the speeds have never changed, and i thought when you were on MAX your speeds fluctuated up and down for the first 10 days, but as said AOL must have me stuck on 2mb still as its never changed, i dunno. :confused:

And I've just tested UKFSN again and it's dropped to 2mb down :eek:

They must really get hammered after 10pm.

Yeah they do, but it doesn't take long before it goes back up from the 2mb, as it only drops at 10pm when the peak hrs start to stop packet loss, and help with latency for gaming, as everyone jumps on and sets all their downloads away, but as said wont be long before it starts to go back up. :)

Yeah it does seem as though AOL have still got me limited to 2mb, as i remember when i regraded to the 2mb gold from silver, i was synching at the 2mb, but only getting 1mb still, and when i phoned AOL they said thats fine as BT have done their job, but they wern't due to switch me to the 2mb for about another 7 days, so still had me limited to the 1mb, but sure enough after id done the above on the day it ws supposed to go to 2mb, it went to 2mb, and they must have me stuck on the 2mb still as my speeds have never fluctuated up or down as said, im probably worrying about nowt and it will all change when i get on UKFSN (i hope). :D

Well my understanding is they gave you 30 days notice, and the contract says you have to tell them within those 30 days if you did not agree to the new T&C's, and so were leaving, so i take it as you are free from paying the rest of the contract, as you have told them within the 30 days as the contract says, i told them last week, got my MAC, had my new order confirmed, all last week, my migration date is the 2nd Feb (this Friday), so i can't see how they can make me pay the rest of the contract off, as it shouldn't matter when the migration goes ahead as i have done as the contract says, gave them notice within their 30 days they gave.

I think the migration date is irrelavent, so if they know you dont agree, are leaving, and have a new order confirmed all within their 30 days notice, then you should be fine, regardless of when your migration is as said, but im not sure, some ppl are saying you will still have to pay as your still going to be using AOL after the 1st while your wating to be switched, and others are saying no you dont.

Thats just a standard e-mail sent out, it always says the bit about 'if you are still in contract', mine did, everyone who has had a MAC has had the same. :)

Yeah, it'll cost me £175 if it turns out like that as i have about 7 months left yet still, i just can't see how they can do it though, the contract says you tell them within the 30 days notice, it doesn't mention having to be migrated away, off their service fully within the 30 days, just you tell them within, which we have done, so i guess its just a wait and see. :)
 
When did you get your MAC code, if it was in January then thats right as a MAC code is valid for 30 days, and they charge you till the last day of the MAC, so that will be in Feb when the MAC runs out, so that counts as another months payment.

Although if they just took a payment, then thats January's payment, so you will get billed for Feburary as well next month as your MAC code validity will have ran into Feb.

Ive just had an e-mail from Jason today at UKFSN saying that Enta havn't received a payment method from me yet, and i need to get it done by 7th Feb, so ive just done it over the phone (i forgot about that), due to be switched tomorrow. :)

I was expecting AOL to be crawling today seen as the new T&C's are in affect, i think ill try a torrent and see if the speeds have changed while im still on them. :D

Odd, i get billed at the end of every month, but thats for the month im in, and i got billed the other day which is for January, unless your a month in advance. :confused:
 
You wanna read the new COS about the FUP, very vague, they can change it how they like, they are saying its unlimited still, but then they say if your usage is excessive they'll throttle you, and they won't let you know your being throttled, or are using to much, so the only way your gona tell is when your speeds plummet, Peak times vary but are currently every evening except Friday and Saturday, so they can change them whenever they like to, good luck to you as they can move the goalposts at will, and theres nowt you can do about it. :p
