Where do I stand with this?

Right, a couple of months back, I got asked to post some photos on the forum for the resort I stayed in on holiday. I also posted a report to 28DL for one of the bars there.

Then out of the blue today, I recieved this PM.

I am the owner of Whispers. You do not have the right to put pictures of my business on the website without my permission. If you do not remove these images in 24 hours, I will report you to the police and find you anywhere you are. Understood?!

Surely not? Where do I stand with that? As a good will gesture, I've asked for the thread to be deleted from 28DL and PM'd the guy back telling him this.

For commercial photography, If you are on or photographing within private property then you will need some kind of model release. Other buildings will require a model release even if photographed from public land.


I'm not sure what your photographed, but Urbex stuff is trespassing and illegal.

although all true, that doesn't reflect form the fact the bloke is being a clunge.

Fair do's for asking the thread to de deleted, if it had been me, that email/PM would have put my back up and weather I'd have been in the right or not, I would have done everything to hack him off even more.

Not very adult or sensible I know, what can i say, I'm a bit of a tool too :)

i think MRLOL is right here tbh :)

its not like everyone on hoilday is going to ask for a model release, & he should be happy he is advertising hes bar/hotel for free :)
 
The bloke is a complete tool. He's basically threatened you in an email, personally I wouldn't let that go. Is photography banned on the premises, have you used them in a commercial manner at all? What country is the bar in, do you need a location release? Holiday snaps being shared on the internet sets a large precedent. I would at least string him along a bit, then hit every relevant review site to let everyone know what sort of chap the owner is.
 
I'd just reply asking him to clarify the "I'll find out where you live" threat. If he then elaborates in an aggressive manner he will no doubt be breaking the terms of the forum and his ISP.

Did you give his place a bad review?! :D
 
Right guys, the thread is now gone, just to make sure and stop this guy from having a massive hissy fit and overloading my PM box! The report on 28DL wasn't exactly fantastic anyway, so its no loss to that community really!

No, I didn't write a bad review, just a report like all 28DL reports, a brief history of the bar etc. It's been closed for neigh on 5 years apparently.

Anyway, cheers for all your help, if he replies, i'll let y'all know how I get on

Its not very clear what the OP meant.

Admittedly a bit strange and a needlessly angry request.

However, I don't see why someone would post holiday photos on 28DL, which is a website about illegal urban photography. As an owner of a business I don't think I would want associations with urbex stuff.
But there are much more diplomatic approaches to avoid negative publicity!

Well, I didn't post my holiday photos on 28DL, I made a report containing the property in question and nothing else.

Ah right so it was an urbex affair. Well you're stuffed really as the pictures you have taken were obtained illegally as a result of trespass?

Right, I want to clarify something, all it was is a bar with an open sort of decking area, all I did was walk through this area, and stick my camera into the bar area through the windows that were there. I never actually entered the building itself. Although I know entering the land itself is probably tresspassing. Please don't take it so abruptly just because i mentioned 28DL!
 
Entering the private property/land is trespassing. You've then made a report on a website which will likely result in others visiting the property. I can see why the guy would be a bit peeved. Don't get me wrong, I like urbex stuff but it comes with risks. One of which is the owner finding out and not being happy! :)
