Whose fence is it?

Nobody "owns a side" unless written into the deeds; and that is VERY VERY VERY rarely done and usually hard to decipher.

I asked the solicitor when we bought our house who owns the fences and he basically said the above and that usually if it's owned by one side, it's illustrated on the map/plan with arrows, but that rarely happens.

Ours are all shared, so I've gone 50/50 with one neighbour, as the previous fence was rotten and blew down, but I paid myself on the other side, as it wasn't desperate for replacement, but I wanted to replace it as part of some building works.
 
If it doesn't say in the deeds/paperwork then no one is responsible really. By law you are only responsible for maintaining the boundary line and that can be an invisible line. It does not need to be a fence. Otherwise all parties involved should get together and share cost if no one is willing to stump up on their own.

Also the argument about whoever side the posts are on is not really valid as every fence I've ever seen the person who paid for it usually has the best side even if that is wrong in some eyes.
 
I had all my fence replaced a few months ago. It's an old house with zero mention on the deeds, but I've always known it to be fully "mine" and the posts are sat on my side of the boundary.

My mindset with it was I'd rather just pay for it myself as it meant I got to choose the style, chose to have the wooden posts replaced with concrete/6" gravel boards and I got to decide the height (the maximum legal limit) etc.

If my neighbours had suddenly decided to replace it with a 2ft palisade fence or something I'd have not been happy, so bear that in mind!

Forgot about this thread! We just decided to go half with the house backing on to ours. Seemed like the right thing to do. 1700 quid lighter mind but hey ho.
 
Fence has gone down with the wind and needs replacing (3 panes plus posts). I've downloaded the title deed from Land Registry but no mention/illustration on this of fence ownership so am I right in saying that it is shared between both properties or is there another document I need to look at?

Yes I believe so.
 
How olds the house and was it built by a developer? If really old 95% chance it’s a shared boundary with nothing further in the deeds. If developer built at some point the transfer deed from the developer will confirm one way or another.

It's around 10 years old and was built by a developer company (can't remember the name). I'm the second owner of the property but I don't remember seeing anything from my solicitor showing but I can get in touch with them to see if there is anything.

I guess you are saying this in regards to it being shared?

Yes I believe it is shared if nothing in the documentation/title plan indicates ownership.
 
To clarify, that was 1700 between us. So 850 each. At a guess fence is probably 11 metres long. And the fence was double sided.
