Why wont my mem work at 1600 XMP

I have the Gigabyte GA-X58A-UD3R and Corsair XMS3 6GB (3x2GB) DDR3 12800C9 (1600MHz)

When I set it to 1600 with the right timings and near enough right volts 1.648v, crysis crashes but if the mem is running at 1333, crysis runs fine?

Ive tried setting the ram volt manually at 1.65, but there isn't a 1.65, it just jumps from 1.640 to 1.660
 
Ive already rma it once due to 1 of the sticks being faulty. Plus because its not my system, I think I'll leave it at 1333 where its happy. I will be running memtest later today, I will be gutted if another stick is faulty
 
Also when I put the mem to 10x it says 1333, but its actually running at 1349. So Is there setting I can change manually that will get it on 1333 without changing the cpu speed?
 
If its paired with an i7 the onboard memory controller is only good for 1066mhz, anything above that is an overclock so its probably not the memory limiting you its the memory controller on the chip itsself.

Yeah Ive just found that out, it says for my i7..........
Memory Type........ 800/1066

So this is prob why crysis crashes when memory is at 1600, but it seems to be fine at 1333. Do you think I should run it at 1066 tho?
