Ok, to cut a long story short,

My wife was arrested on saturday, on a charge of obtaining money by deception. She sold some items in april totalling £550 and the buyer claims he hasnt had them.

My wife has no proof of postage, except me, who was there when she posted them.

The police have siezed my desktop PC to search the hard drives for evidence. According to the detective who took it all they will do is copy my hard drives and then i will get it back. He gave me a phone number and said ring tomorrow to see if it will be released.

Its my pride and joy ( see sig ) and it will break my heart not to get it back :(

Im worried about my wife but im even more worried about losing my PC, or it getting damaged when they take the hard drives out. They say experts will do it. All my photos are on it, including pictures of my 2 week old son :(

Why wouldnt they take the HDDs nd keave the rest of the very expensive hardware.

Ive had to buy a laptop toaday to get back online.

What happens if my pc is damaged while they have it, can i claim against them?

And the annoying thing is, why do they automatically think my wifes in the wrong? i saw her post the items, i helped her pack them. Ive half a mind to pay the buyer a visit

I would be surprised if you didn't get it back. It's not there's to keep really and once they get what they want they will have no need for it so they will give it back.

It's there job really to assume she hasn't sent the items. After all they don't know that you're telling the truth. They have to base their decision on evidence, not what a husband/wife is saying.

That's harsh, I don't see how they could get away with keeping it, its not like they're taking it to *******.

How come no proof of postage for something so expensive?

I think you need to get your priorities straight and I don’t think you should let her read your post.

Hope your wife works things out

Could they not have supervised you while you backed it all up?

It all happened so quickly. to be honest i was in to much shock to back up.

ive got most of my stuff, just missing the last few weeks pics/documents.

What good is the PC going to do them when the dispute is over whether goods got posted or not?

They want to search for emails apparently between the buyer and the seller. I tried to explain that i reformatted last month but it fell on deaf ears.

Got no dodgy software or images on there have you?

If not, then nothing to worry about.

They might even use forensics to retrieve the emails.

They are police not IT experts, how would they know what you were and werent backing up?

and yes you will get it back, they are not theives and yes if it is damaged you will be able to claim.

But...... as previously stated sort out your priorities mate. A pc is just a thing, I love mine dont get me wrong, but your wife is your life partner and soul mate, you should possibly re-evaluate your life a little.

£550 worth of goods and you dont have proof?

Thats just silly, anything of value get proof, send special delivery or insured courier.

Harsh but true, your word isnt enough.

Nothing dodgy on there at all.

and i assume the forensics will work on the copies of the drives they make? i dont like the thought of them raping my raptor

Emails that were no doubt given as evidence by the claimant. I still don't see what good it's going to do them. It looks like a massive invasion of privacy for a basic small claim court item, I'd see a solicitor.

Yeah i know :(

They said if she can raise the money to refund them she will get off with a caution. Thats pretty much what the detective ssaid, she cant prove the goods were sent, but the buyer can prove he paid ( bank transfer )

We can raise the money. There goes conroe!
