Hi,
I bought Windows 10 oem by mistake and I am building my own gaming rig.
Can I legally use the oem version on my own build Or should I return it and get the retail version.

You can use the OEM version. There are some limitations but there are ways around said limitations.

oem is for system builders that sells the system with the OS. its not meant for personal use.

but theres only win8 oem that allows system builders to use it for personal use ..

but most people don't care breaking the EULA

its pretty confusing. What version is right for home use where you want to install on multiple computers, not at the same time but different computers different hardware. Are they hardware locked as before? With windows 7 retail you could take it from pc to pc, what is the equivalent now?

It's up to you, a simple explanation is that OEM is tied to the first system it's installed on whereas retail is tied to it's owner, so with retail you can buy/build a new PC at a later date and install it on that instead.

Personally I have always gone OEM as I build my PC's to last a long time so by the time I replace the motherboard the is a new Windows out anyway.
