Windows 8.1 dropping wifi when connecting to device over lan & ics

Not sure if this thread is supposed to be in software/windows or networking, but I have a problem with windows 8.1 and wifi + ICS ( internet connection sharing).

I have the current situation:

The pin needs internet to function.
What happens is Windows often ( but not always, about 50% of the boots) drops the wifi connection.
I have pinned down ICS to the culprit, more specifically, windows 8.1 thinks the lan port/pin terminal somehow has an internet connection, in network overview it shows ''internet connection'' on the port of the pin sometimes, and sometimes ''no internet connection''. If ICS is turned off, windows never detects the lan as an internet connection and therefore never drops the wifi.

When it says ''no internet connection'' on the LAN, all is fine, when it says ''internet connection'', it disconnects from wifi and only manually reconnects to it ( not automatically).

This is irrelevant of AP on wifi ( we've tried over a dozen).
The culprit is windows thinking the lan port has an internet connection, because the moment the CCV pin terminal is booted and thus pingable, Windows often drops wifi.

''allow other network users to manage or turn of this connection'' box is DESELECTED in the ICS tab on the wifi, as are all power saving features everywhere.

Windows 8.1 x64 Embedded Pro retail ( tried various drivers for the Intel ac 7260 wifi, and also tried the x86 windows version and drivers as a test on 1 device to no avail).


So, tl:dr, 2 questions:
Why does windows 8.1 sometimes think the LAN port contains an internet connection despite it being nothing but a pin terminal there ?
Is it possible to make windows stop disconnecting wifi if a cabled lan is plugged in and contains internet ( or not in this case, but windows thinks so) ? ( note I have already tried prioritising the wifi adapter over the lan adapter, it doesn't matter, as soon as windows says ''internet connection'' on the LAN( which is about 30 secs after booting if the pin hasn't been power cycled, or 4-5 mins until the CCV terminal has booted up and is pingable after a power cycle), wifi disconnects ( I can re-connect manually though).

Or are these questions for the Microsoft forums :D ?
