Working notice period, issues?!

Right,

Having found a new job and formally being offered the position in writing I put my notice in last friday, giving my employer 1 weeks notice meaning I would finish this friday.

Last month all staff were late being paid as the company was totally skint and was waiting for a cheque to clear in order to pay us all.

Monday afternoon came and I was called into the office and told that because work was so quiet and money was so tight that they were going to let me go that day. Now this wasnt my decision and thought somehow I am entitled to the rest of the week even though they havent the work to give me and sent me home early?

Just wondered if anyone had some advice on where I stand legally. Also, I never was given a written contract, so I have nothing in writing saying my hours of work etc.

Anyone able to shed some more light on my rights on this one? Going in friday to collect my P45 and owed wages, so would like to know if I am owed for this week mainly?

Rule number one with any job is have a contract. Simple really because now they have basically let you go you have nothing to reference to say 1. how notice you need to give them and they give you etc 2. You have no terms of employment with that company.

Am I getting this right you handed your notice in and then later on they let you go? If this is the case to me it sounds like they are just pulling a fast one so they dont have to pay you anything up until your last day.
 
i would have thought you would still be entitled to the weeks wage legally.
they may be trying to appeal with your soft side and trying to save a few quid, if its a small company its up to you if you let it go or not, also think abotu if you ever need a decent reference or anything from them before making waves :p
 
I have worked there for 6 months,

I handed the notice in friday afternoon after getting in writing an official offer of employment from my new employer. I took my notice up to the boss friday lunchtime and by monday lunchtime they were letting me go.

It is a small company (now 2 staff)...
 
I suggest you call the ACAS Helpline in the morning (08457 47 47 47). They will ask all the relevant questions and tell you what your rights are - while there's been some correct advice in this thread, there's also been some comments here which look authoritative but are absolute rubbish.
 
Under 12 months you have no rights for termination. They can let you go at any time, for any reason.

If you have worked for an employer for more than one month you are entitled to one week of notice at a minimum (per the Employment Rights Act 1996), and more if your contract stipulates it.

You are entitled to be paid for the week that constitutes your notice period. I'd advise you seek it if the money means something to you.
All depends on your contract, you had any paid holidays in that time?
This is a relevant point. You are also entitled to be paid your accrued holiday per the Working Time Regulations 1998. This is a minimum of 28 days per year, which would be appx 14 days for 6 months of employment. However, you of course deduct any holiday days you have taken in that 6 month period, and additional subtract any public or bank holidays in that period you have not worked.

As for holiday entitlement, I have taken 3 days holiday this year so far, 2 of them were only because the boss "needed time to sort himself out" and made us all have a long 4 day weekend.

ACAS is always a good first port of call but they will almost certainly ask you the same questions you have been asked here. Did you have a contract of employment and what did it state was the minimum term of notice required?

If a company has policies in place they have to abide by them failing that it falls back to the statutory minimums set out in employment law.
 
If it was me I'd just stay home for 1 week without paying even though you are entitled to be given 1 weeks notice as other have said but don't forget that they must pay you for any outstanding holidays ie you could use this holiday the week you are supposed to leave earlier, up to you to decide.
 
Yes, they have to pay you and, yes, you should insist on it. Contact them and inform them of this as soon as possible.
