I bought a cheap Vostro laptop from everybody's favourite auction site on the 27th April which has not yet turned up despite allegedly being posted on the 29th April.

Seller provided me with a tracking no. (only when I asked for one) and upon tracking the item it showed up as delivered and signed for by a person named 'Milnes' on the 30th April to an address in York. I live in Hull.

Seller assures me it was posted to the correct address, I have no reason to disbelieve them. He says its down to the couriers and he's waiting for them to resolve the problem. Twice I've asked for an update but he has nothing to tell me, the last time I asked was yesterday. So now its been 11 days.

I want to ask for a full refund and then tell him to resolve the issue with his couriers as I see no reason why I should have to wait any longer. As he has stated that the item was posted 9 days ago its clear to me that the item is lost.

Am I being unreasonable?

Is he obligated to refund me at this stage, if I request a refund.

Sorry for the long post but wanted to set the facts down clearly.

If the couriers say it was delivered to york and you're in Hull quite clearly you haven't signed for it, and as such should be able to request your money back upon the fact that you have paid for, and not recieved the goods, not sure how that stands legally, and forums are the worst place for legal advice
