My nephew has just gotten a £700 fine for "keeping a vehicle without a valid vehicle licence"

He got banned. I took over taxing the car, added it to my trade policy. The mot ran out so we sorned the car.

The v5 never got transfered because why would it.

I had several v5s in my name from about 14, obviously didnt get my licence till 17, never got fined. Since when have you needed a license to own a car?

It's been parked up 3 months now he has just gotten this fine. The case was heard at a magistrates court 300ish miles away from where the cars been registered to for 5 years.

Bit puzzled.
 
Obviously you broke the law...

Well I didn't because I didn't get fined.

Obviously he did because he got banned lol.But the car was insured and taxed and legal on the road until its mot expired and which point I wasn't prepared to mot the vehicle so I parked it off road and sorned it.

I'm failing to see what law we broke.

So the story goes.
A guy at work, his friend got a speeding fine.
When he paid the fine he should have sent in his license but didn't.
He got slapped with a £1100 fine, I'm guessing he has an old paper driving license.
Police/ government must be topping up the coffers.
 
Well, googling the offence you've given, it says -

(1B) Where a vehicle for . . . which a vehicle licence is in force is transferred by the holder of the vehicle licence to another person, the vehicle licence is to be treated for the purposes of subsection (1A) as no longer in force . . ..

Sounds like maybe he had it licensed, gave you the car so the license is null and void...?

What exactly is a vehicle license? I don't think mine has a 'license'?
 
You never transferred the V5 so what do you expect

Anyone selling a vehicle must inform the DVLA of the transfer as a legal requirement, and failure to do so can result in a fine or prosecution.

Vehicle licence is VED.

If the V5 is still in his name/address then he would have gotten several letters including at least one telling him of the impending court action.

At the first letter that was his opportunity to rectify any errors by contacting them. He didn't.

His (in)action had consequences of which he's now reaping.

The case will have been heard most likely at TEC in Northhampton
 
How did you "take over taxing the car" without the V5 or reminder letters? Do you have email confirmation that you paid the tax?

Could the fine be for a period before you "took over"?
 
If the car was added to a motor trade policy and the details entered correctly in the MID then does this not exclude it from having to be taxed?
Dealers forecourts have vehicles on them that are not taxed and cost of taxation is passed on to the buyer at purchase unless included as part of the deal.

These untaxed cars can be test driven on the road by prospective purchasers providing trade plates are displayed.
