X38-DS4 power issue

Basically everytime I turn the computer off i have to remove the power lead, clear the cmos with the battery out, before it will power on again. Any ideas? I have updated the bios to the newest version also, although im not 100% on weather its restoring the orginal from backup.

I have a Gigabyte X38 DS4
3870x2 gpu
OCZ 600w mod extreme psu (all working fine have checked this with multimeter)
2x2gb kingston hyperx ram ddr28500
e8600

Edit- In doing this it also resets the bios clock, if thats of any significance.

Also, assuming it is the bios that is faulty, does anyone know if it is soldered onto the board or if it is one of those removable types, i would def try swapping one out b4 a new mobo.

A little update, after I have it on, I can get into the restored bios hut if I try and save anything(even if I change no options and just save and exit) the comp powers off and then I have to proceed to CMOS rest etc
