Yes you can certainly request a repair or replacement.
It is not reasonable to expect it to last only 13 months.

You do not *have* to go the MS route although I would contact them and see what they say.

Ring your local store, explain your situation and see what they say.
If they say "nope older than 12 months" tell them that your understanding of the SOGA is that they have to repair or replace it as it is not "fit for purpose" nor has it lasted "a reasonable period of time".

The sales guy is unlikely to know the SOGA. Try not to get mad if he doesn't.

Next thing to do is speak to their customer services department. You'll get the brush off here too.

Next you speak to Consumer Direct and Trading Standards.

Now you need to put it into writing, email the retailer and send a copy of it in the post to the retailer. Try to direct it to someone high up their management ladder. Maybe google for their directors.

The specific links that give you the bits you need have been posted here a few times, I'll dig them up.

yeah its the 3 red lights, and ive tried all the tricks, its dead

edit cheers VIRII, il ring MS tomorrow, bit hungover today, funny that after everything, it was indiana jones dvd that killed it

Here she is:
Just a few links with some very important consumer information in them that many people simply do not know.

Not sure where you want to put this, might make a good sticky.

Useful links and contacts re customer relations:

Distance selling (i.e. buying stuff over the internet or mail order)
http://www.dti.gov.uk/consumers/fact-sheets/page24635.html

Extended Warranties (interestingly they have to explain your statutory rights to you when selling you one - yet to meet a shopworker who knows them....)
http://www.dti.gov.uk/consumers/fact-sheets/page10720.html

Sale of Goods Act (this is the daddy)
http://www.dti.gov.uk/consumers/fact-sheets/page24700.html

Supply of Goods and Services (more to do with tradesmen than products)
http://www.dti.gov.uk/consumers/fact-sheets/page24702.html

People who can help you if you have problems exercising your consumer rights:

http://www.tradingstandards.gov.uk/

http://www.consumerdirect.gov.uk/

Help specifically for electrical items (Xbox 360, HDTV etc)

http://www.consumerdirect.gov.uk/goods-ser...es/fs_e01.shtml

I think some sort of more detailed discussion or sticky on what to do when your local GAME refuse to refund you might be useful - especially after Xmas lol.

EDIT
I found this article when helping someone out recently regarding "restocking" fees, it is basic but puts a little flesh on the bones of the articles I linked.
Read it for your own protection ......

Wasn't there a thread like this the other week? Basically the guy rang Microsoft and got it replaced, even though it was outside the warranty time. Microsoft are usually pretty good about these things.

Yup.
But you might get a refurb not a new unit.

A friend of mine just had his replaced by MS and it was older than 12 months, they sent him a refurb unit.

Cheers VIRII, have added this post to fav. 360 has been going strong since last Jan, and my only 360.
Just in case though I think I'll hold on to this :).

Unlucky mate, just remembered when you mentioned it that your other one went pop as you got it from me I felt little bad. hopefully they will honour a replacement, I got a few strange artifacts last night playing Amped 3 so hoping mine isnt on the way out. First real problem Ive had

well i rang MS today, was delighted to speak to an english sounding voice (no offense) anyhoo they flux of it being they wanted me to pay £70 as im a week and a half out of warranty, which is a complete joke to be honest, so looks like im going to do battle with **** in the coming weeks, i really dont have time for this hassle though, and im really annoyed at the amount of cash this thing costs for it to go boom.

EDIT - another wonderful update, rang **** giving them the whole VIRII speach and they basically told me to get lost, so im ringing **** customer services, which sadly arnt open today, i really dont have the patience for this at all

It's disgusting that we the consumer should pay for their messed up design.

I can't see my 360 lasting the test of time. actaully i'm already getting read errors on my recently replaced (with a brand new unit) 360!

Lets hope this V2 that's coming out is more reliable.

I am really suprised that Microsoft doesn't get more stick, other than a few moans and groans on bulletin boards.

I pray mine lasts, I think the warranty is up in the next 2 months, never had any problems except some dashboard crashes and pgr3 twice during net play.

il try and keep this thread updated with how its going

my advice, get it replaced before your warranty runs out, even if its fine

hehe, might give it a thump or two if it gives me any more hints of a failure.

My launch unit kicked the bucket a few days ago as well. I rang up MS who want 70 quid to send me a refurb. I got this unit from a large supermarket - if I took it back to them, what's likely to happen?

It's either that or abuse return policy (my mates 360 is under warranty) :(

EDIT: Whoops, competitor I think >_>

I was worried about this scenario happening with my 360 so before christmas I sold mine for £220. Then bought a new bundle pack for £300 and sold all the extras for £80.

I hope you get a replacement or a fix, good luck :)
