xmas game bought online, opened, want to take it back

my mum got me 2 games for xmas that i thought were going to be of my taste however really weren't so i want to take them back. Problem i have is that 1 i have opened the disc and installed so the plastic sleeve isn't on the game no more, it was bought online so i cant go into a store and explain with them.

What are the chances of my being able to get a refund on the 2 games?

i was planning on pleading ignorance and saying that they don't work on my pc as its "too old" to play them games and say i didn't understand all the jargon about the system requirements.

the games are never winter nights 2 and flight simulator x

Pretty much zero chance, just sell them on the MM. Can always try saying your computer is too old but 99% sure it won't work.
 
Have you checked the online retailer's returns policy? I am fairly certain I have returned games after the plastic wrapper has been removed.

In future if you aren't sure about a game - download the demo :D

take it back and say you don't agree with the EULA, they are obliged to refund you (though they will kick up a stink).

whats the EULA? im guessing like whats in the game? e.g. killing?

2 problems with that

1. can it work if I ring them even though my mum bought it? i know my mum would never bother doing that for me :( would i be able to email them and say it, or get my mum to email them as she might be able to do that, but not lying too much on the phone she wouldn't

2. if its about not liking whats in the game as in the killing, kind of hard to say i dont agree with that as one of the games is a flight simulator
 
No the EULA is the license agreement you should read [but no one does] before clicking I Agree to get on with it.

Just call/email them and say you don't agree with the EULA and you want a refund. Dunno if it would work, as said I can see them getting stroppy.

I`m guessing you have a PC from your sig... and these games are for the PC... so call up and say your mom purchased you these games for christmas and you opened 1 and then realized that it was for the PC... but you have a MAC!!!
 
If you go down the EULA road, u better be prepared to have actually READ the EULA so u can state exactly which bit you're not happy with so you can justify your circumstances.

And if you decide to do this, please post back to the forum as I'd be interested to hear what they said ;)
 
call the the long distance selling act depending on the price of the games, also the cool off period should be included for such items surely? although they have price limits on both of these before they come into effect.

Always worth a shot as may scare them into a refund :D

this is possibly your best option... the xmas ignorance road is often the easiest way to go - you might only get credit at the online shop but this would surely be good enough for your return!

perfect idea, will attempt this tomorrow and post back whats happens. i really appreciate the help. :cool:

Distance Selling Act only covers unopened items. The idea being an item turns up and you realise it is the wrong one/shape/colour/sex/etc. If you opened it - tough.

No it doesn't, as long as it is returned in the condition it was sent in it can be sent back.

Unfortunately that is not the case. A two second google for "distance selling act" gives the accurate answer.

Ah sorry I didn't know there was an exception for software, I know you can send things back you've opened though such as a mouse as long as it's within 7 days and good conditoon
 
I think one of the reasons why it might be hard to return software is that you can open it and take the CD key from it. Thats why you can often return xbox/ps games easily compared to PC games. Might be a tough one to return.

Check there aren't Mac versions of the games though. They may offer a swop if there is.

I think the EULA idea is very good. Can't see how they can get out of that argument.
