XP Home upgrade, upgrade path

Guys

A question on upgrade path's for XP home upgrade. I have XP home upgrade disk which im about to install in a new build for a family member, im going to be using a win 98 disk as the validating criteria, my question is (and bare in mind my first install of this was over six years ago) if the original install was from and OEM 98 will this mean that the XP licence cant be transfered?, I have a pretty good idea on how licence transfer and upgrade work now ie vista, but cant remeber if its the same for XP, the whole reason for the question is that i cant honestly remeber which disk i upgraded from whether it was an OEM or a retail 98 (I had both at the time).

Any idea?

just fire up the XP install and when it asks for previous windows media put the 98 disk in and itll go through, doesnt need a code or anything.

isnt it limited by the media used when first installed 6 yr ago?

It's not a technical limitation, but it makes the difference between complying with the EULA and not complying (I won't use the illegal/legal term because violating an EULA doesn't go against any laws).

ok, so how do i know?, is there any way for me to find out which disk i used?, I genuinely have no idea, I apreciate what your saying but my intention is not to break or bend any EULA's but merely to install this disk.
