I guess quite a few OcUK's have uploaded to YouTube before so would appreciated input...... (Though it's risky asking in GD!)

I uploaded a video to YouTube this afternoon, it's a video that was used in our Sixth Form revue and is the teachers/pupils miming to Rockstar (by Nickelback) and the song pauses for a few bits where the person actually sings their line (but 98% of it is the original song without audio from the video recording).

I got an email from YouTube this evening saying
Dear Westyfield2,

Video Disabled

A copyright owner has claimed it owns some or all of the audio content in your video *;)*;)*;). The audio content identified in your video is Rockstar by Nickelback. We regret to inform you that your video has been blocked from playback due to a music rights issue.

Replace Your Audio with AudioSwap

Don't worry, we have plenty of music available for your use. Please visit our AudioSwap library to learn how you can easily replace the audio in your video with any track from our growing library of fully licensed songs.

Other Options

If you think there's been a mistake, or you have other questions, please visit the Copyright Notice page in your account.

Sincerely,
The YouTube Content Identification Team

And I logged into YouTube to have a look at my account and it says:

Replace Audio
Use AudioSwap to replace your video's audio with any track from our growing library of authorized music. YouTube will republish your video with the new audio track.

Mute Audio
You can mute the audio for this video. YouTube will republish your video with the audio permanently muted.

Dispute Claim
If you believe that this claim was made in error, or that you are otherwise authorized to use the content at issue, you can dispute this claim with the alleged copyright owner. You will be guided through a web-based form, and your dispute will be passed to them for review.

Please note that if you protest the claim made against your video, we will make your video available to the alleged copyright owner to view. This is necessary for them to review the dispute, and will happen regardless of the privacy settings you placed on your video. If your video is private and you are not willing to allow the them to view it, we unfortunately cannot accept your dispute. However, if your video is private, this will be clearly noted to them at the time of viewing your video and they are required to respect the privacy and confidentiality of your video.

Also, note that if the alleged copyright owner responds to your dispute by asserting their ownership, your video will be permanently removed from YouTube.

For more information on this process, please see the Video ID Disputes section in our Help Center.

Remove Video
You can delete this video from YouTube.

Now the bit I don't get is that if one was very naughty and decided to pirate/rip the audio off a YouTube video to MP3 (and I'm sure no-one here knew that was possible :p), one would use http://uk.youtube.com/watch?v=VmQyyCQxFwU or http://uk.youtube.com/watch?v=cjO-MqQr_VA as they're complete versions of the song without inturuptions from our teachers/sixth formers!

So, I'd like the video to stay, and 'legally' it's less bad than those two above...

Any ideas? I was thinking of doing the "Dispute Claim" option, but don't want to get sued!

At least they were friendly and not to serious about it, throwing in some ;) for good measure.

Seriously though, you won't get sued. Theres literally no chance. The very very worst thing that will happen is they will delete your youtube account and bar you from making a new one. Dispute the claim if you really want the video to stay.

Yeah seems a bit stupid if you ask me, this whole copyright stuff is a total racket.

....I know how to rip youtube to mp3, but why would you want to, the quailty is poor.

I would dispute it become a quick Youtube reviles other accounts with the same song and they haven't suspended the video, audio for an investigation.

If you want to dispute it with them you can always try to defend your video on the grounds of parody being protected under fair use. Wouldn't want to rely on it if things got legal but it might get them to back off.
