Youtube question - copyrighted music

Hi All

Got a quick youtube question...

Over the weekend I uploaded my first ever youtube video, a short slide show of pics of my 12 week old boy set to a piece of music.

I uploaded it as a private video with the intention of my parents, brother etc being able to watch it but no one else.

However, youtube queried the copyrighted music I had used, I acknowedged that it was copyrighted music. on the video management screen I now have this text:

What does this mean?

I can still view the video which is fine, however with it set to private I'm unable to share the video. I believe there are normally options so I would be able to add specific usernames so that they could view it?

However I just have "sharing not available"

It seems strange to me that I could set it to public so anyone can view it but I'm not allowed to share it with just my family!!

Is there anything I can do to be able to share this with my family and no one else?
 
Well, those are your options. Either upload it somewhere that doesn't care, remove the copyrighted music or put it on your own site
 
I realise those are my options but what I don't get is how come I can go and watch hundreds of videos featuring copyrighted music on youtube but I can't privately share a video which has some music on it?

Copyrights effect everyone, including your family. For example, you wouldn't be allowed to rip a copy of a movie and give it to your family, just like you wouldn't be able to rip a copy of a movie and put it on Youtube for everyone.

I realise that but if I was to set the video to public that's fine, I can share it with the whole world but I can't just share it with my family, which seems odd to me!?!?

I do realise it, what I am saying is that Youtube would be fine with me setting the video to public and all would be fine and dandy with the whole world being able to view it but have an issue with me allowing only family to see it.

To use your film ripping analogy, it's as though youtube would be happy to allow me to rip the film and allow everyone in the world to view it but would not allow me to rip it and show it to just my parents!!

You're not allowed to use any copyrighted material on Youtube whether it's public or private. Any videos you see public with copyrighted materials such as music, are doing it and just getting away with it. Youtube do their best to remove videos like that, but there are so many there are bound to be some that slip through the system. Either that, or they have permission to use the music in their video.

Add a copyright disclaimer in the description, it should sort it out. Something like this:
"Copyright Disclaimer Under Section 107 of the Copyright Act 1976, allowance is made for "fair use" for purposes such as criticism, comment, news reporting, teaching, scholarship, and research. Fair use is a use permitted by copyright statute that might otherwise be infringing. Non-profit, educational or personal use tips the balance in favor of fair use."

Are you sure it's public? If you've uploaded it as a private video but can't share it - I imagine you're the only user who could view it, which would be fine because it's your video.
 
You may already know this but there are easy work arounds for this issue. Google "avoid youtube copyright music" for it. Simply slowing the audio track down in something like Audacity by a miniscule amount which won't be detectable by the listener does the trick.

At present it is private but the option is there for me to make it public, which I have checked and it lets me do, which seems odd as I can share it with the world but not just my family?!?!

In future I shall find copyright free music to use I was just puzzled as to why I can make it public and it's ok but I can't share it privately... very odd!

Ahh I see - In that case, I would imagine that when you put it as private it scans the video for copyright music and shuts it off if it detects it. Whereas, when it's public it waits until there is a DMCA takedown notice from the record label (I think it's called DMCA notice? :p).

Guess you're probably right, but it does seem like an odd way to do things.

As I say, in future I shall use copyright free music and save myself any hassle! :)
 
Just put it as unlisted then you can send a link to your family and friends.

However later on the rights owners may choose to block it in countries that they are in and then I think maybe the audio will be muted if that happens.

I guess on private mode copyright owners can't see it or have ads on it which is why youtube won't let you share it out.
