Technically speaking, regardless of it you are using it for commercial or non-commercial use you need to seek permission from all those who have rights over it in order to use it.

The chances of being caught are minimal, but if you do get found out they will sue your ass off.

But do the likes of "Richard and Judy" or a major news channel actually pay royalities every time they show a youtube clip and if so does that monies go to google or what??

These are the holes (or loopholes) i question.
